Sandranj,

I feel that I cannot live anymore.

I jost got notice that USCIS sent 3rd RFE

1st RFE was fonafide marriage and moral character.

2nd RFE was fonafide marriage and abuse evidence. So, I responded.

I just got notice from USCIS website that they sent 3rd RFE

I have no idea what I can do now. Do I have to meet another psychiatrist? I have no money for it.

Sandranj, you have lots of experiences on VAWA. Could you advise me what I can do. Could you mention some of your cases who got 3rd RFE

I missed my sister's wedding, my grandmother's funeral. what else do I need to miss......

Please help...

You are very lucky that they sent you 2 RFEs regarding bonafide marriage. Sometimes they send just one RFE regarding a  bonafide marriage if the person did not convince them. When you get the RFE let me know and we take from there.

I never got an RFE in my life!!!. I answer RFE often, but the VAWA petitioners submitted their cases without my help, many of them with help of their attorneys.I always say if someone receives one RFE is because the person didn't do a good job when filing VAWA, but receiving 2,3  request of evidence then the case is a mess.

Thank you, Sandranj.

I will let you know when I got the 3rd RFE from USCIS.

I don't know whether you remember me or not, I sent you a message when I didnot get the 2nd RFE for 2 months. As you advised me, I contacted ombusdman twice, and contacted two congressman. Then, I received the 2nd RFE just a 4 days before the dead line date. Due to I had no time, I tried to do my best for the response and sent the response next day because the 4days included weekends. Fortunately, they got my respnse the last day of the dead line. Then, I got notice 3rd RFE

As you know, I file I360 by myself because there was no one to help me at the time. First of all, I am a man. Second of all, my case is emotional and mental abuse case. It is almost about a year since I filed I360. Thanks to God, I could find this forum and knew about you, Sandranj.

I really need your advice. God bless you.

@sandranj I wish I knew you and this forum before I submitted my petition. When I first heard about VAWA, I called a bunch of immigration attorneys. All of them asked for thousands. I kinda gave up because I couldn't afford it. After two months, an attorney from a non-profit organization helped me submit my case. She told me I didn't have to submit evidence for marriage in good faith because my I-130 was approved. As a result, I got RFE about bonafide marriage one month after. Since then, I haven't heard anything about my case. I appreciate the attorney's help but it is very important to submit the right documents at the beginning because VAWA takes almost a year to get a decision, and none of us want to hear denials.

As I mentioned yesterday when you get the  RFE  we take from there.  I will help you to answer the RFE  just if I believe  100% that you  have a VAWA case.

@sandranj Hello Sandra, just a quick question, I have my I-485 and I-131 cases pending. And my K-1 is expired. My friends invited me to go on a short vacation to Puerto Rico, I have consulted with USCIS and TSA, they both said it's okay. However, I wanna just double check with you to make sure so that I don't get in trouble. Thank you in advance.

It's always okay to leave the country, the trouble arises when you try to get back in!! TSA and USCIS staff cannot give legal advice and won't accurately inform you of the consequences of leaving without AP while adjustment of status is pending. See this information on USCIS webpage: https://my.uscis.gov/helpcenter/article/can-i-travel-while-my-i-485-is-pending

If you leave without a valid AP, your I-485 will be deemed abandoned. Be very careful! I don't believe it's wise to risk your case by taking out of country vacations. Safest bet is to wait for the green card.

Also, without AP or a visa, you won't be allowed back in. You will even be denied boarding by the airline and will be stranded in Puerto Rico. Bad, bad advice by USCIS and TSA people.

Edit: I realize Puerto Rico is a US territory, but think about the risk of your plane being diverted into another country for whatever reason! If that happens, you'll be stuck.
