I sent 360.765 and 485   dec.8th

received receipt on dec,23

received RFE for good moral in Dec,31 

sent on January 19, USCIS received on January , 22

Did BIO January,18 

so far just waiting :(

trying to cooperate with waiting , sometimes can't take it anymore , just praying !!!

Wow, you at least got your biometrics appointment and you filed later then I did. The waiting game is unbearable... Praying for you!

Holaaa porfin pude crear una cuenta y escribir, les cuento mi caso, yo aplique por vawa en feb 2016 y me aprobaron agosto 17, estoy casada con ciudadano pero no envie mi paquete completo, en diciembre 5 del 2016 envie 485, 765 y 131, tuve la cita para las biometricas el lunes 6 de febrero y ayer martes me aparecio un update diciendo que me enviaron pedir evidencia adicional para la 765, la verdad nose de que se trate ni siquiera sabia que podian pedir evidencia para la 765... asi que aun continua la espera...a alguien le a pasao lo mismo?

Note:

I checked on USCIS: they only have options if I change lawyers or remove my lawyer from my case, but not if I keep my lawyer & change the mail preference.

I understand, but in my case I'd like to at least have the option to receive notices directly instead. My lawyer's sometimes "too busy" to let me know on time and honestly after 6 months of delays & stress caused by his mistakes.

I haven't decided to remove him from my case yet but I am definitely scared to leave him in full control of my situation.

Timeline: 

May 2016 retained an attorney and started to prepare my VAWA petition. 

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((

Hi Guys,, my RFE has no deadline on when to respond back,,, since I have to submit fingerprints to FBI,  I know it will be around 3 months until I send it back to Vermont!!! Is it normal to received RFE with no deadline to response?  I heard they usually give you 30 days to send back information in regard of RFE!  Any experience on this??? Guys,,, thanks for the help

Hola yo pase por lo mismo y envie una carta a uscis vermont y otra a donde se hace el cambio de domicilio, yo especifique que la persona que me estaba ayudando no me contestaba ni mensajes, emails, llamadas y que cuando iba no estaba, y les comente que paso un mes para que me notificara de que tenia mis recibos y prima facie y que yo no queria correr el riesgo de que enviaran algun dato importante y que por su falta de profesionalismo yo no lo recibiera a tiempo y les puse que porfavor me mandaran todo directamente a mi, y puse mi direccion y los datos de la persona que no queria que se le enviara, y puse mi firma y copia de identificacion, y lo envie y paso el tiempo y nunca me contestaron pero la aprobacion solo me llego directamente a mi

I totally understand. And to be honest I would not want him to be on anyone's case if he makes mistakes that delay everything. I think our situations are complicated as is and there is no need to make us more miserable.

 

If you do not feel he pays enough attention to your case, but still want to keep him, call him, email him do whatever you can to make him understand your life is in his hands. That's what I do. My attorney has not made any mistakes so far, just does not know everything about the VAWA and options. I call them every week to check in on the status of my i-765 case since I really want to start working and having somewhat of a normal life. The attorney's assistants always help me and email me confirming the information they provided over the phone.

 

I think it is really important to have a good attorney if you choose to have one. Otherwise it will just be yet another bump in the road.

Hey Peru, As far as I know the maximum time to respond to an RFE is 12 weeks (84 days). Though I would not trust that time frame, since USCIS can adjust case-by-case. It usually is 30 days. If you have an attorney, ask him to contact Vermont asking to extend the RFE based on a good cause (you've submitted your fingerprints to the FBI, along with a tracking number and a time frame posted on the FBI website). Requests to extend are usually denied, but I would give it a go. If they deny it, try getting affidavits from friends stating your good moral character any volunteer work you might be doing. 

 

Does your RFE state “an extension of time will not be granted for you to submit the requested evidence”?

 

But it is awfully odd that there is no deadline specified...

Lunalotto you probably forgot to submit some documents necessary to obtain the EAD.

 

You need to fill out online form AR11 to change your address regarding form I-485, and after 10 days go to the infopass to confirm that your address was changed because most of the time USCIS does not update the address.

 

(Es probable que usted se olvidó de presentar algunos documentos necesarios para obtener  el permiso de trabajo.Para cambiar su dirección usted necesita llenar el formulario AR11 electrónicamente y despues de 10 dias va al infopass para confirmar que su  dirección ha sido cambiada,  porque la mayoria de las veces  la Immigration no actualiza la dirección okº.

Hi sandra since they didn't mention deadline,,, should I call Vermont and explain to then that it might take a while before submitting good moral clearance since FBI takes 12-14 weeks to provide background check!!  Thanks for your help and I'm from NJ as we'll!!! :)
