They received my vawa October 3rd and I didn't get a response yet.

I think their working on cases from AUGUST 8 2016...IM STILL WAITING ON MINE AS WELL.

whats the prima facie? my attorney said my priority day is august 10 and to keep waiting that it should be approved soon.

You'll like;y need a psych letter (ask Sandra) you dont have to use whom the atty recommended,

switch one of your off days to a weekday, go talk to your local legal aide. Join a church & get out

of the employers home on Sundays, there you'll meet ppl, just stay cautious in what you reveal

Hello everyone, Here is my case. I came in to the U.S on an F-1 Visa. I was born in El Salvador, from Nicaraguan parents who fled the Sandinista Revolution in the Seventies. My father was a well to-do businessman and They had a store in San Salvador he could attend to. 

 

After completing my studies in Miami, where my sister, aunt, and mother legally reside, I met my husband (LGBT). We were married last year in Austin, Texas. 

 

My spouse suffered from Borderline Personality disorder and neurosis. He was also a Type 1 Diabetic. In spite of his abuse, I loved him quite dearly. He passed away at the age of 32, from Diabetic ketoacidosis, two months ago.

 

At the time of his passing, I had already filed for VAWA, and had ample evidence. My concern is the following, we bought a property in Sacramento, mostly with my money. My mother has moved back to Nicaragua and tells me all about it.

 

Joe and I wanted to live the dream, we knew that would entail a beach life somewhere. I am tempted to go to the country all my family is originally from, but I don't want to shut the door on the U.S. Not at my young (relative) age of 32.

 

I am just so heartbroken by his passing, and how my ultimate goal was to make our marriage work, and be there for each other no matter what. After all that had happened, we still loved each other deeply.

 

Am I living, or just surviving? Am I happy with this American life? One that I believe killed him. Had his Government offered their employees access to Insulin, but no, he was a seasonal employee thus FEPBlue would only cover so much of his insulin. This country killed him. This country abandoned this young man. 

 

My questions are the following: 

 

1) Should I file another VAWA as a widower? If so, if I file for VAWA widower, that would be second I360 form, in the U.S., and then if I were to leave the country, would it be an issue if I overstayed my student visa by two years? It says D/S on my I-94.

 

2) I submitted an I765 with my Prima Facie and planning to change status in the U.S. Am I entitled to advanced parole?

 

In case you're wondering, I'm a software engineer with degrees from two big schools. Natural entrepreneur and Homeowner, My husband was valedictorian, and a Federal employee. I will contribute to this nation if given the chance. 

 

Sell (Profit) and leave or stay and fight? I think he would have wanted me to stay here only if my needs where met, and without access to the workplace, and the power to vote and try to change things above, I can't shine. I wasn't meant to live a life of mediocrity in the shadows.

So I was having a normal day and just casually asked a friend of mine how is his cousin because I havent seen or heard of her in a while.  He proceeds to tell me she ran away to Canada.  She is married to her US Citizen husband for over 10 years and he never filed for her.  What can she do?  

Should she get an immigration lawyer?  Can anything be done since she is no longer in USA?  I don't know all the details.

I am going briefly to explain what happens if you file VAWA/AOS and leave /reenter the Country with AP  and you leave and try to reenter as a widow.

 

VAWA : If you file VAWA/AOS and leave/reenter with AP you will not accrue unlawful presence.

 

I-360(widow)- The Immigration Law defines the Duration of Stay (D/S the period you can stay as long you are enrolled as a full-time student in an educational program at an approved school and complying with all the terms of your status. But the Immigration Law is clear when states" If you have complied with all the terms and conditions of your status".  But a nonimmigrant admitted for D/S will be considered an overstay just if an immigration judge finds in the course of removal proceedings that the individual has violated status; or if USCIS during adjudication of an application for an immigration benefit decides that a violation of status occurred. You overstayed and if you leave and later on you decide to file for an immigration benefit your petition might be approved but the US.Consulate abroad will not issue the Immigrant visa for you considering that you did not comply with all the terms and conditions of your  F1 status.

 

Regarding your personal questions to stay or to leave, if you are living or just surviving I believe is a question that just you can answer. I love this Country with all my heart and I can't picture myself living in my home Country(Brazil) ever again. You will go nowhere by blaming the U.S for your spouse death. You see as the U.S "killed" him but  I see on a daily basis how this Country is changing people lives. In  2016 the U.S resettled 84,994 refugees. Every year this Country grants thousands of petitions for victims of human traffic and for victims of criminal activity. Millions of dollars are provided every year for several programs such as Medicaid, Medicare etc. Nicaragua is the poorest country in Central America.The GDP (PPP) per capita in Nicaragua is $ 5,452 and the U.S 57,436 . Every year  12.000/14.000 VAWA petitions are approved in the U.S and men/women have their lives transformed because of this. Sometimes we have to let go of the life that we planned.  The difference between you and the person living the dream is the amount of action that each one put into action. I truly believe that we don't  get what we wish for, we don't get what you hope, we get what we believe. What do you believe?
