hi afternoon everyone I have a question I need some help with. I have a pending AOS and VAWA. I recently got a live in job but the family is terrible...am on the verge of looking a place as my husband kicked me out his house and this job was my only home here in NYC. I want to move to new Orleans but my lawyer is saying I cannot move because of jurisdiction and she also stated New Orleans is not immigrant friendly but that's the only place I have family members and that's where I can get a job too plus living expense here is NYC is crazy...I need help on what to do..please Thank you

You can move to a different State, but because you have an attorney representing you THEN  USCIS will set up your interview in your attorney State. When VAWA is approved the attorney should inform USCIS that you will attend the interview in NYC.

As soon you move to  you must submit two notarized letters to inform that you moved to NYC,one for your I-360 and another one for I-485.

Folks VSC will not adjudicate adjustment of  status anymore. They will ship the case to NBC  the NBC will check if  any document is missing and then NBC will issue an RFE, but the local office will adjudicate the AOS.

If you ( VAWA petitioner) lives abroad and you received  an immigrant visa abroad  and  your derivatives  want to immigrate to the U.S after you then the process needs to be initiated at the Consular abroad. If you received the GC inside the U.S then submit the I-824 to VSC.

Is there a filing fee for i-765 and i-131, if we are filing for an extension ?

I had all the filing fees waived for i-765 and i-131 when I submitted I-360 with I-485. But when I sent applications to renew both i-765 and I-131. USCIS returned back my packet and sent a note saying

"We are returning your I-765 and/or I-131 relating to your I-485 application as the proper fee, or fee waiver, has not been submitted with your filing(s). If you filed Form I-485 and paid the Form I-485 application fee, no additional fee is required to also file form I-765/I-131. Please review your filings(s) and resubmit with proper fee or fee waiver."

What should I do now ?

New Orleans is definately not an immigrant friendly

and have reported many raids. Dont you know anyone

you can at times spend your off days with? Sometimes

when one spend 24/7 in those homes the ppl takes

advantage and you may have made it known you have

no place else to go. Getting out when you are off should

open new avenues even a small room to rent until you find

another job. Never let ppl you work with know all thats

going on in your life

Will the NBC forward my I-485 to the local office closest to me or to my attorney?

They will foward to your attorney. In order to forward to you then your attorney has to inform USCIS that he/she will not be present in your interview and to schedule the interview in the State where you are living, but you must change the address with USCIS as soon you move to a different place.

Can I file the form i 360 under VAWA online if I live abroad?

You can file abroad just if the abuse happened INSIDE the U.S and you left the U.S fleeing  abuse, or if your husband is employed by the U.S government or if he is a navy/air force or military personnell stationed abroad. You must submit the forms to Vermont!

Thank you. It's the same state but she's about an hour away, so her local office is in a different county than mine. Hers seems to have a little faster processing times so that's good.

Thank you for responding. I moved to a different state after the abuse happened and he was still calling and threatening me so I came back to my country.
