Randranj and fellow vawa applicants, I have a question, anyone please advice.

I have just moved to WA State. I had to change food stamps and everything for the kids from FL to WA. Now apart from my kids food stamp and cash assistance they gave me food stamp and cash assistance too, they told me both cash and food are not federal benefit, its state benefit. I told them i cannot take  cash assistance because i will have my green card denied because of being a public charge. But they said its not federal funds its state money i qualify for it and i must take it,  its not an option since am homeless living  in shelter and the state is helping me with that money to get housing and be in a home with the kids.

What is your opinion about this cash assistance?.Am i not going to be denied my permanent resident because of being public charge? Please advice, Thank you

Are you being offered the cash assistance for yourself or for your kids? If it's for your US citizen kids, then there should be no problems what so ever.

@MsSara it's good to hear from you, how have you been? I hope you like it in WA much better.

Cash assistance for yourself counts as a public charge hopefully it won't be taken against you at the aos interview eventually, but try to find income as soon as possible so it wouldn't be long term

Its for me and my 2 USC kids. I tried to explain to them that i dont want it because of immigration pending vawa, they said its a must that i must have it not a choice to use it to get housing because the kids needs to be in housing and not homeless. I will check with immigration lawyers here who are familiar with immigration lwas and WA State law

There doesn't seem to be a problem if you move while your case is pending as long as the address is updated promptly with uscis Via mail followed infopass to ensure the update.That being said;

NYC is expensive but one of (if not the most) convenient, diverse places and definitely more immigrant friendly (which can affect your elegibility for benefits too)

If a family member will take you in and you have job lead to save and get on your feet then it may work.

Do your research before you decide (transportation, independence, cost, income)

Best of luck

Is there a filing fee for i-765 and i-131, if we are filing for an extension ?

I had all the filing fees waived for i-765 and i-131 when I submitted I-360 with I-485. But when I sent applications to renew both i-765 and I-131. USCIS returned back my packet and sent a note saying

"We are returning your I-765 and/or I-131 relating to your I-485 application as the proper fee, or fee waiver, has not been submitted with your filing(s). If you filed Form I-485 and paid the Form I-485 application fee, no additional fee is required to also file form I-765/I-131. Please review your filings(s) and resubmit with proper fee or fee waiver."

What should I do now ?

Did you attach copy of your I485 NOA for your initial filing? I suggest if you have added it would have been waived, processed and renewed accordingly.
