First I read that article and I am horrified that there is even one person out there who thinks like that article writer. That is ridiculous. Do you realize it would be way worse if that was the policy. A US citizen could get his/her spouse deported by claiming fraud. That is cruel and unfair.

Second, what do you mean "have anyone here gone through VAWA fraud in the beneficiary's attempt to gain citizenship?" What are you asking exactly?

Show me one example of a US citizen getting an immigrant deported due to marriage fraud.  Show me one example of a US citizen getting an immigrant deported due to reporting an immigrant who has made false allegations of abuse.  The fact is, SOME, beneficiaries make false claims of abuse in order to receive citizenship.  They, men AND women, do this through VAWA.  I just got to this thread, so I am just asking if anyone has gone through that experience (of hell).

" If the US citizen claims marriage fraud, within a “reasonable” amount of time, and would like to dissolve the marriage, an annulment should be granted and the spouse should be sent back to his/her home country." That is what the article says that is what I am responding to.

So you are joining a forum of abuse victims to ask them whether any of them are faking the abuse? That is disrespectful in my honest opinion. Considering what we have been through, honestly I don't care if some people are making false claims, the program is very good for many of us who have lived through nightmares with abusive USC or LPR spouses.

No one has been attacked, Tortmaster. I asked if anyone has experienced this abuse of VAWA.  You should care if people are making false claims to the government; that is called fraud, it is a crime.

You can be sure there are people in this forum who are faking it and simply getting the information to help their case; however, you are correct, this would be more appropriate for a new thread specifically for that.

If you think people are here faking, try going through the humiliation, the abuse itself and the aftermath in a domestic violence court. I respect your views but I really think you don't know what you're asking. Gathering documents and writing your own statement to Vermont is one of the most difficult assignment I guess any victim here will testify. It's like rewriting the abuse on paper and replaying it in your thoughts which brings back lots of horrifying scenes.

The guys at Vermont have extensivev years of training and critically go through every case. If you're here claiming people are faking abuse for US citizenship, then I'd suggest try and be in our shoes and I bet silence and prayers will be your option. I almost lost my eyesight with my left eye still in recovery, with other humiliating events just because I am married to a USC. And you think my story with proof and others on forum are faking?

I guess you're lost and confused on this forum. And it's an insulting way to add on to our hell we've been through which we still are recovering from.

Just getting to this thread....have anyone here gone through VAWA fraud in the beneficiary's attempt to gain citizenship? http://bit.ly/EndMarriageFraud

Yes we have seen some VAWA denials. To what your linked petition is implying, that VAWA has a high rate of fraud - news flash, all visas have fraudulent activity, as well as benefits, insurance and etc. Someone will always try to bypass the system. There are US citizens that get paid to marry immigrants and provide them the visa. When applying for VAWA you have to provide documents proving that it is a bonafide marriage and that it was entered in good faith. So most of the suggested adjustments, are actually already implemented and the rest just do not make sense.

I am sorry for anyone that was used to gain visas, but understand, that all the women that are active in this forum day in and day out are not the ones that are committing the fraud, therefore, cannot help you with your question. VisaJourney is very strict on their policies and do not allow any advice on how to commit fraud. And while I understand the frustration of the people that were tricked, so were all of us. Some of us are blind, suffering from PTSD's, Depression, tried committing suicide, lost the ability to have kids and in general have spend some time in hospitals due to our injuries and are too scared to go back home. So the petition to allow US citizens and LPR's to get rid of us, only enables the abuser and does not protect the abused.

I do not see it passing and I know that each and everyone of us here will not let it pass through congress. Especially now.

Good luck in your search for answers.

1-That link lacks logic and compassion even if there  is someone who does lie it's not easy; it's easier to stay in a "green card" marriage or even remarry than to go through this process that takes months & sometimes  years of agony until one is approved then waiting another period of time to adjust status!!

2-It takes a very special person to go ask strangers "hey Have you committed fraud?"

Are you holding your breath for an answer? Come on!!!!

There is no fee to renew the EAD. You  have to send the application to Vermont.

Hello sandraj my ead expires 09/09/2017 originally i applied under c(31) but this time i want to switch to c(9) because my i485 is pending. can i do that without affecting my eligibility to renew my ead? If so do i have to pay the fee?

If your I-485 is pending you can file the form I-765 using the category  C9. Yes, you have to pay USCIS fees if you can't afford to pay the fees then file form I-912.

You cannot. The I-912 must be submitted along with form I-765. If you did not pay the fees and did not submit the I 912 then  USCIS  will reject your I-765.There is no fee if the person is renewing the EAD.

He should be aware that the Court will not allow him to stay because of you because he is  NOT immediately eligible to obtain permanent residence (a green card) right ou have. He will have remain outside the United States until he gets the immigrant visa now.

He should discuss with his attorney the possibility to ask the Court  instead of being deported if he signs a voluntary departure then in the future he will need just one waiver to overcome unlawful presence instead two waivers (unlawful presence and deportation), and get ready for the waiver,it costs a fortune( attorneys fees around $6.000 to $10.000) one waiver. The waivers that I prepare have 60/90 pages.
