It's taking a long time, most local offices are taking 6/9 months to set up the interview.

There is no fee to renew the EAD. You  have to send the application to Vermont.

Ask the Congress person to inquire on your behalf again and contact the USCIS Ombudsman again as well.

I have a friend (this is in San Francisco, California) who was in the process of immigration through marriage, and the husband became extremely abusive. She got out safely and is in a shelter, because it was really bad.

 

She is now in VAWA. She has an attorney helping via a nonprofit service. But in a recent conversation with the husband, he threatened to file an annulment, intending to ruin the immigration process. She heard that this can be expensive to fight. She heard of a case where a woman in similar shoes had to spend $20K on a private attorney to fight this.

 

Does anyone know anything about an annulment tactic, and the consequences? I should also point out that according to her, he's penniless, so if annulments are costly, he won't be making good on the threat.

She should file for divorce NOW. She should not wait to see what he will do with her. 

 

If she doesn't have kids or assets to share she should go to the Court and ask a  PRO SE DIVORCE KIT, and she doesn't need an attorney to file for divorce,the package comes with instructions.

There is no priority date for spouses of U.S Citizens, just for spouses of green card holders.  The priority date is when the form I-360 was received by USCIS.

Thanks my understanding is that was filed this morning, and she's going to try and get him served tomorrow.

12/24/2010 I proposed. She accepted and stayed.

02/25/2011 Married!

03/19/2012 FINALLY submitted the AOS paperwork: I-130, I-485, I-765, etc.

03/23/2012 Received notification that USCIS has received everything.

03/26/2012 Biometrics Appointment Notice: April 23, 2012.

04/02/2012 NOA's received. Now we wait...

04/23/2012 Biometrics completed.

05/18/2012 EAD card mailed but not yet received.

06/06/2012 Rough interview but we think we're approved! Website says i485 status "Card Production".

06/12/2012 We received the "Welcome the United States" letters! Website says Green Card was mailed.

LIMBO: Green card lost in mail. Facing the possibility of paying hundreds in fees and basically repeating the entire process.

All good now! USPS lost it, then found it.

04/24/14 Back to VJ to get help with I-751, Removal of Conditions.

05/31/14 Mailed I-751 finally, with less than a week to deadline!

06/02/14 NOA1 (that was fast!)

07/01/14 Biometrics

7/25/14 Approved for Removal of Conditions

I did hear back from my congressman after i told them to inquire again. Vermont told them that my case is pending "security clearances" and they don't know how long it is going to  take. I think they just don't want to be bothered with my case. 

I contacted the ombudsman again waiting to hear if i will get the same response.

You could also consider scheduling an infopass appointment if all else fails

You could schedule one for your local office, explain the situation, then hopefully the agent will contact VSC directly. Doing that combined with Congress and Ombudsman will ensure a 3-fold approach that should hopefully yield results.

Appointment schedule is always available for the following 14 days only. If you check back the next day, appointments should be available. You might just have to get lucky and go on the site early. 

This just means that all appointments are booked for the next 14 days, so don't worry.
