Recently USCIS updated some rules related to EAD, allowing EAD renewal to be filed 180 days before expiration and in case if the new EAD is not issued before the previous one expires, it looks like it is okay to continue working with this new rule. Do you think this information is correct.

USCIS just updated the Processing Time Information for Vermont ( https://egov.uscis.gov/cris/processTimesDisplayInit.do )

 

There is a pretty big jump in the I-360 processing dates from last month's data:

May 20  as of  March 31 

July 25  as of  April 30

 

Fingers crossed that good news is coming our way soon!

Hello everyone, happy to see those approvals and of Sandra still doing such an amazing work helping people here. 3 years ago she helped me with all my stuff and it couldn't have gone any better. I sent my packet(I-360/I-765/I-465/Evidence ect) in mid June 2014, and by mid of Jan 2015, I became a Permanent Resident :) and thanks to her there were no mistakes. no RFE, no nothing along  the way lol 

 

With that said I am here hoping I could get your help Sandra once again. I am planning to file N-400 as soon as I am able, and that seems to be about mid Oct 2017 according to USCIS calculator. Being that I am planning to file with approved VAWA and had a question from looking at the application figured I would ask here as I'm sure there would be other people asking the same question when going to file with approved VAWA.

 

Part 1. Information about your eligibility.

I have to check "Other" and I have to write "INA sec 319 (a)" correct?

I saw an old post of yours from searching here on visajourney in this thread, http://www.visajourney.com/forums/topic/395574-naturalization-after-vawa/ that said this below and just wanted to make sure that this information is still correct?

"you have to send everything that a regular applicant does such as copy of your GC, photos, fees, divorce decree, copy of birth certificate and translation, copy of the I360 approval notice etc... When choosing the option eligibility for naturalization (question number D of Part 2) which is about your eligibility for naturalization you should choose OTHER and write-" INA sec 319 (a), and attach copy of the memo from Uscis regarding naturalization for individual with vawa approved. Make sure in your cover letter you specify your eligibility otherwise the first person touching your case might not accept your form N-400, because most of them do not know about the 3 years rule for victims of domestic violence.Do not forget to send a copy of the memorandum because some officers do not know about the 3 years rule ok.

I do have a couple other questions if you are able to help, I know you are very busy with helping a lot of people, and I am in no rush as still have months before I can file so if you can whenever you would be able to fit me in lol great!!  The Automatic EAD renewal is like a safety net (or grace period if you will)  for people who have a pending EAD renewal application in case  their current EAD expires before the new card arrives, they are still authorized to work automatically for up to 180 days.

 

This is to protect jobs in case of delays.
