I know I can submit 1-751 on bases of abuse however when will I be able to do this? I read in the I-751 instructions that due to it being a waiver you can submit anytime when you receive conditional green card and that you do not have to wait for 3 months before 2 years anniversary. Does anyone have any experience on this or be able to advise me. I don't want to submit it too soon if it will be a problem. thank you

 

Victims of abuse can file the I-751 waiver anytime after receiving the green card ok.

Your husband can cancel his l130 and l864 when he wants.You  can't transfer  a pending  l485 until your  l360 is approved. 

 

In case he withdraws  the l130 you have to file a new AOS.If USCIS sets up am interview you  have to go and then ask the IO to put the AOS on hold until final adjudication  of your l360

God bless everyone who put an efforts to help in this form especially @sandranj.

 

First of all for anybody need a way how to format any VAWA case especially the cover letter  i have simple form based on mine from a lawyer and all the requirements documents  that need to be submitted . would love to share it whoever needs it.

 

I have a question, I submitted I 360, I 485, I 765 together, the I 765 on Cat C(09)  which really am confused about it which category is the right C(31) or C(9) however today i got REF saying :

Submit a photocopy of personal date page of valid passport, which include a photograph and biographic information.

 

This photocopy must be clear and readable in order to accurately determine the photo i identity.

 

You can also provide documents such as unexpired foreign passport, driver license etc..   

 

Please note that i already submitted my passport copy and the i 94 with a copy of my US Visa and don't why they asking again , My concern that my passport expired this month and it takes time to renew it and have to fly to the embassy location to get it. the question is Is it acceptable to send them the expired passport copy or has to be a valid passport ?

Category c09 is correct.

When I submitted my VAWA packet my passport had already expired I still provided a copy and included copies of a valid ID as well. A valid ID is still acceptable so if you have a Driver's License or state id you're probably gonna be ok with that... if not:

 

The RFE gives you more than 80 days to respond and you may even request more time, while passports usually take 4-8 weeks depending on the embassy. most of them accept renewal by mail.

 

Contact your embassy and find out if you can mail the passport, money order & application and ask them how long it usually takes, it may fall within the timeframe your RFE allows anyway.

Guys quick question. 

 

I just received my receipts for i485 and 601a waiver. They indicated they are in Vermont Service Center and have EAC receipt numbers.

 

Was wondering. Aren't they supposed to be processed through the National Benefits Center and have an MSC receipt number?

 

Did something change?

I795 updated on uscis website saying Name was updated. 

I485 updated to Rfe.  

I dont understand all my updates. For ead i dont think i spelled my name wrong. And im worried for i485, what could they possibly need from me? I hope its an easy rfe. 

 

Any thoughts and advice please...

It could be just for you to submit your medical exam (form I-693) it's usually something minor. The toughest part is over  for you. Let us know when you get it.

Congrats on the approval!! When was your filing date for the I-360, and what date were you approved?

Well, just had my AOS interview... The officer just asked me questipns from the AOS application to make sure everything was correct, then marked that I got divorced and said that another officer will have to check the case and I'll get the reply in the mail. Don't know if it's a good sign or not:(

Even when it's your first time; EAD + SSN are sufficient, so now that you're only renewing them it shouldn't have to be difficult specially with your EAD valid for another 6 months!

I didn't open my divorce case yet, my lawyer is asking for $1,200 

When should we open the case? Should I wait till my approval? I don't even know where is my ex husband, his address...
