Klsbrn,

You cannot go to your country just with your EAD card. You need an advance parole. And if you have this document, is just counseling to travel abroad if you are not out of status.

Thank You for your reply.

I have an advance parole but I went to motorvehicle this week to renew my driver license, it is expiring on 06/15/17 but they said they can not renew it because of immigration process. My EAD is expiring on December but still I couldn't get the new license. They will call me in 3 to 5 business day after talking with immigration. I am not sure if I will have any problem when reentering to US.

Hi Klsbrn,

We have a close timeline. My  receipt date is September, 29. No updates since then either.

I was wondering, what date should we count? The receipt date or the notice date?

I don't have any idea. I was not expecting this much. After approval, we will also wait for green card interview, is that right?

Oh, really? They don't want to renew your drive license? It's not nice. I don't understand why. Maybe someone here ,that lives in NY, can tell you if they had a similar experience.

Well, if you are not out of status , I think you would not have a problem. But is just my opinion.

Oh, yeah. After approval is another waiting journey until have the interview. All this process require a lot of patience and faith. But in the end everything will work out for us.

It makes almost a two month difference for me, which sucks but patience is key. I would give it about 10 months before inquiring through ombudsman.

Oh, really? Almost two months between your receipt date and notice date? Wow, it is a lot. Yeah, patience, patience is all we need.

Yeah, I guess I will not hear from them until around August.

What's your date?

This is not right, as long as your presence is lawful (which it is while your case is pending) you're eligible to obtain a NY state id or drivers license. You should go back and try again with a different employee or even a different location.

Even when it's your first time; EAD + SSN are sufficient, so now that you're only renewing them it shouldn't have to be difficult specially with your EAD valid for another 6 months!

Sandraj, and other folks,

I got a 2nd RFE, but it wasn't delivered. So, once it passed a month, I went to www.uscis.gov/e-request and request for a missing notice in mail.

AND, I got this yesterday that

"USCUS cannot answer your inquiry over the phone or through a referal. You must submit yout inquiry in written form and with the original signature of the inquirer."

Although I followed the step that I'm supposed to if the notice in mail was missed, I have no idea what I can do now.

Sandraj, and other folks who had similar situation before, please help me.

Because of I filed by myself, I have no one to be helped.

Thank you.

You will always get this letter in the mail if you try to ask questions about vawa on the phone, it's their protocol for security reasons, any correspondence regarding VAWA must be submitted in writing.

You can also do the following together if time is limited:

1-Schedule infopass appointment so you can go in person to resolve the missing RFE issue.

2- Contact your congressman and ask them to inquire on your behalf.

They will have you sign a release form and will communicate with USCIS then get back to you.

My Receipt Date is 12/21 and Notice Date is 2/2. 6 weeks in between but I think it's because of the holidays.

You  don't need to request a FOIA,  you  can should submit a copy  of the I130  and ask Uscis to search in their  database a copy of his birth certificate. They will not take your  l130 approval and just think oh he is American, they use the  approval to locate the file and get a copy of the birth certificate.

I see. I thought that the approval stating his status was sufficient. But i even sent a copy of his A# and ssn. I hope they will look to retrieve the file since i didn't ask them to do so but only sent the copies

Some of these lawyers really don't know what they are doing. My lawyer said that the i130 approval was enough. Smh what do I do now Sandra? I send my i360 in December.
