Jan 24th - I-360 received at VSC 
Feb 14th - received receipt notice for i360
Feb 21- prima facie issued
March 02 - received prima facie for i360 in mail 
March 20 - i485 transferred to new office, Vermont 
March 31- sent out additional correspondence/evidence for i360 with blue sheet attached to prima facie 
April 3rd - additional correspondence delivered 
April 5th - additional correspondence received and under review by VAWA unit 
April 12th - EAD and AP applications transferred to Vermont 
May 23rd - EAD approved and card is being produced 
May 26th - EAD/AP card received 
June 6th - VAWA approved 💃🏼

Hey everyone! Is there anything I should bring to the interview besides what's listed in the letter? I know it's a stupid question, but I'm freaking out! 

Like proof of me coming in the country legally or marriage certificate, divorce papers, vawa approval?

Yes! It's all God! There was no day that I did not talk to God about my case. I would go to bed with it on my mind and wake up with it on my mind. I prayed that he would approve it for me by July/aug but I guess he had better plans for me.

Folks almost all cases that I get here to review are missing 90% of the information that I need to review the case and add what is missing.  A VAWA case is adjudicated completely different than family-based petitions.USCIS focus in the intent entering into marriage, because of this the COURTSHIP is so important to describe and so many people keep getting RFE stating the person did not describe the Courtship in details. I had many cases approved without a single document showing commingling finances.Your affidavit is extremely important.  In this post, I will write how to prove a bonafide marriage in a VAWA petition.

 

Cheating, addiction, spouses not sleeping at home, bisexual partner are not grounds for VAWA.   Abandonment, by itself, may not be enough to get a VAWA approved. There is a HUGE difference between an "unpleasant marriage" and abuse. I see often people mentioning how t he/he suffered because the spouses cheating on her/him, not coming home to sleep, how terrible was her/his life because of the spouse's addiction. Please do not waste your time and my time with this kind of affidavit, please.

 

If you had a lease agreement, health/life /car insurance for example, or joint bank account and you don't have these documents anymore or you are unable to get these documents then you need to show to USCIS that you at least tried to obtain these documents. Email the former landlord or the insurance company asking a copy of the document that you need and submit to USCIS  a copy of your email and the answer received ok.

 

You should mention in your affidavit if you have these documents, if not why not. Lease agreement, joint bank account, tax filed jointly, health, car, life, health, car, life insurance that has both of your names on the policy,  utility bills showing both names, mortgage document showing both names.

 

Many victims were mentally abused then they should attend therapy and get a psychological evaluation done stating Your background, the onset of the problems, abuse in details, tests performed (ask just the BAI and BDI tests), diagnosis, treatment plan, and referral. DO NOT SHOW YOUR AFFIDAVIT TO THE PSYCHOLOGIST.  When you start therapy tell upfront to the psychologist/counselor that you will need a psychological evaluation because many of them refuse to give the evaluation.

 

The victims of domestic violence do not have a marriage like ordinary couples have, that being said  USCIS  gives a lot of attention to details that USCIS does not consider in family-based petitions. The Service considers the dynamic of abusive relationships. Please, when writing your own affidavit try to follow what I am mentioning bellow. You can get affidavits from friends and family living abroad, USCIS takes into consideration. The affidavits written abroad don't need to be notarized. All affiants must write in the affidavit date and place of birth, current address, and phone number. The  Affidavit must be dated and signed. All affidavits written in a foreign language must be translated into English. It doesn't need to be a certified translator, any third party can translate the affidavit, you cannot translate. The translator must write on a separate sheet a CERTIFICATION OF TRANSLATION and attached to the foreign document.

 

The Immigration Law states that the legal validity of a marriage is determined by the law of the place where the marriage was celebrated, despite a customary marriage is valid where the marriage was celebrated  USCIS will not accept this kind of marriage if it was not registered with the Civil Authorities. The dissolution of a customary marriage will not be valid if dissolved in the presence of elders of both parties. The divorce decree must be issued by a high Court.  

 

 

USCIS will not consider a customary marriage if it's not registered in the Country where the marriage occurred.

When and Where did you meet your husband?

How long did you date before you were married?

How often did you talk to him/her?

When did  you tell your family and friends about him/her

When did he tell your family and friends about you?

What do you have in common with him/her? age, religion, sports?

Describe what did you use to do when dating? movies, dinner out, visiting parks, trips together? describe

Where did you spend the holidays when dating and/or engaged( Valentine's day, Christmas, New Year, your birthday, his/her birthday, Thanksgiving?

Tell about how you fell in love

Tell about he/she fell in love

When did he/she propose? 

Did you buy or get a ring?

Did you call your family to let them know about the engagement, how did they react?

Describe the wedding, who attended

How and with who did you celebrate your wedding? party, dinner out? friends, family, co-workers?

Describe what he/she wore on the wedding day? describe the mood, anxious, happy?

Tell about the marriage, how long everything was ok, when did start the abuse?

What do I do about the benefit that I am receiving with my prima facie? Do I tell them to stop it? I was supposed to recieve the benefit until august when my prima facie was scheduled to expire.

Wow....if they send for rfe can u do an affidavit like this for bonifide marriage ? This is in Dept I love this.

Bring the birth certificate, marriage certificate and divorce decree, if any, a valid passport, if you have children then bring the children's birth certificate as well and your work permit.

It's not advised to receive TANF and food stamp for you, you can use for the kids , after filing the AOS.

Congratulations on such a rapid approval!! You must be ecstatic! I thought they adjudicated petitions in the order received?!?!
