if you got the RFE just for god moral character this is good news if your VAWA was filed over 4 months ago.

Hi - I need help. Im getting confused. 

 

 

My ex husband and I filed i130/485/765 altogether. 

Got my EAD. But not long after the marriage, abuse happens. I have the reports and evidences. 

 

Filed Vawa on Sept 2016 

Got prima facie 2 weeks later. 

 

Scheduled for I130/485 interview november. 

My lawyer went to the interview and informed the IO about the vawa filed. 

December: my ex got a denial for 130 : he did not show up for the interviw. 

Dec : i485 transferred to a different office ( called uscis and said case is pending ) 

 

EAD will expire will expire on Apr. asked my lawyer to renew it, said that they never had a case that its possible to renew it since my 485 is based on family petition and now that I am under VAWA, its different category now. My lawyer is also telling me to that I have to file a new 485 incase vawa is approved. 

 

Called USCIS - they said 485 is pending therefore I can renew my ead, but my lawyer is telling me otherwise. Help me.

Hello to everyone. On 5th January I had an an an interview. And since then I didnt hear from USICIS anything. In the office they said they will change my family name, and it ll take about 3 weeks . Its been about a month, and I didnt hear anything. I started worrying a lot. Trump scares me((  Did anyone had similar situation?

We're all scared. Trust me. I check my phone every time I pick it up to see if there are any updates. You can always call the National Customer Service and they might give you more info on how long you should wait until opening an inquiry about a case that is out of normal processing times. Don't forget to keep us posted!

What did you submit for good moral character? Is a state background check sufficient? Or do they ask for more according to the RFE you recieved?

I see you filed I-485 and I-765 on a different date (12/06/2016) from I-360.

....Do you mind sharing withy me why?..

....Is your husband USC?  or LPR?

....Why didn't you file concurrently?

....Do you have receipt of notice for both  I-485 and I-765

 

Am asking you this because I filed only I-360 (have receipt of notice), am LPR spouse, the legal team helping me told I cant file  I-360, I-485, I-765 concurrently, but when I asked immigration attorney she said to me that they were supposed to file I-360 and I-765 same time, the wait for vawa approval to adjust status. Am thinking of filing I-765 by myself now a month after filing I-360.

I remember 3 cases of VAWA/AOS denied because of sham marriages and their new I485, because they got married, were denied as well.

What's the difference between the two? They said I couldn't prove joint residence even though i provided all the bills in our names insurance, energy, etc and marriage in good faith after describing everything even in my affidavits from family, friends, etc. i even explained the situation when we started living apart. i dont know

I think its a game of luck really. I have friends that showed up to the 1-485 interview barely prepared and got approved asap. i really dont know why i met a witch that morning lol shes made my life so difficult.

peanutbutter 18 your attorney doesn't anything about VAWA. You are a self-petitioner(I-130) has a pending AOS then you renew your EAD,and you don't have to file a new I-485.

NSARA  Do you have a visa number available? because you cannot file form I-485 without a visa number available this is because your husband is  GC holder .

 

YOU can file I-765 but you will not receive a work permit until your VAWA is approved
