Hello Sandra, when sending a letter to VSC Vawa unit, should i include a copy receipt of the approved petition? I also told my representatives to kindly withdraw their representation of me since its approved , i prefer to communicate with them by myself in future but for some reasons they (lawyer) said if they ever receive anything they'll forward to me, i just dont get why and what they're up to? Though they're not representing me for I-485 and i get uscis responses for I-485 directly to my address... Can i ask/mention in the letter to terminate their representation of me in I-360?

If you are filing i765 you have to file i485 along with it. If you husband of exhusband is a US citizen. I recall someone stated that their i765 was denied because the didn't file i485.

If you have a pending AOS then file form I-765 category C 9, if you don't have a pending AOS you can file category C31 but you will not receive the work permit before your Vawa is approved.

You don't need to send a copy of the approval notice to inform USCIS that your attorney is not representing you anymore.Call your lawyer and ask proof that he informed uscis  about the end of his representation. 

 

If your attorney represents you in the AOS you should submit a letter about it s well.

thanks Sandra That's what I was thinking... I dont have pending AOS and I filed only 765 with category C9 on May 12 and I did't get receipt yet, so I thought they just rejected it, that's why I wanted to confirmation from you,  now I guess i'll still wait for receipt;

One more question please, in case of VAWA approval, will they inform i 765 team about it or should I inform them ? :))

They would reject your l765 category C9 cause you  don't have a pending l485. 

 Well I always tell people don't file  l765 category C31 cause Uscis most of the times does not pay attention that the  person filed the form before vawa approval.  It's advised just spouses of GC holder to file category CR1 when they approve the  vawa petition.

Just curious to know - what happens in a situation where someone leaves their abusive spouse, files for vawa, has vawa approved and green card subsequently approved and then reconciles and gets back with spouse that was abusive to them... will this have an impact on their application for citizenship?  Cc: @sandranj

Mine has been useless to me as well. My spouse is a usc but my lawyer told me that i wasn't eligible to concurrently file i485 & i765 with i360 whereas the uscis website says differently. So i went ahead and filed  i485 & i765 on my own. All 3 cases are currently pending. My take is, many lawyers are not fully knowledgeable about vawa and they care most about getting paid. That is why we need to be proactive and take matter into our own hands sometimes.  On the other side, we are very thankful to so someone like sandraj to help us and provide us with meaningful information in this journey.

Anyone seen the article this week that parts of IL the police are refusing to issue certifications even

when victims cooperate, many excuses are that the cases were old while there is no definitive timeline

to apply for U visa. other places may just adopt this way so those who are victims looking to apply for U

visa in any state should request that asap, cooperate & the request can be made to the DA also

May 23rd to June 6th just gonna be 2 weeks just be patient nothing to worry

Lol! May 23rd was barely two weeks ago not 5 weeks. It can take anywhere from 3-6 weeks to get receipts ... you are still within the time frame
