Doesn't take up to a year, based on past posts, it takes approximately 4-6 months for AOS interview to be scheduled from date of vawa approval. I also believe that how fast it goes depends on how backlogged or busy your local office is.

By the way, congratulations on your vawa approval. 😊

Thank you for your reply!

My local field office is showing 485 processing as of June 20 2016, seems like they are one of the offices that have a high workload. Just hoping it isn't a full year of time for the AOS to come current. Is it possible that I won't have an interview, the USCIS website states "interviews, when necessary" for concurrent filing.

Thought once u have EAD u can't apply for benefits...i heard it is a bad for your vawa....i already have Medicaid...so maybe I won't get prima?

Vawa petitioners can apply for public benefits .  97% of the States do not give food stamp and cash assistance, just medicaid.

I don't know if prima facie can be requested. It's seems as if they just issue it randomly. Ask Sandra.

You can write to VSC and explain that you need to see a doctor and you need to have Medicaid for this and until now theu did not send you the prime facie and ask them to  issue the prima facie for you.

I've never heard of any vawa applicant that didn't have an interview. Probably possible but rare.

Hello,

Brazilian National applying for permanent residence through VAWA. Have one specific question about timing.

We submitted my VAWA application (I-360, I-765, I-485) on July 22 2016. Shorty after applying I received my prima facie and refund of application fee. I received my approved I-765 and EAD in September 2016. Just last week, the VAWA application was approved (May 19 2017).

Now that the I-360 is approved, I understand that the VSC will forward my I-485 to the local field office for the AOS review. My question is what is the timing for review/approval for this AOS.

Once the local office receives the 485 docs and approved VAWA, will they sit on it for a year until the processing date comes current or does the local office see that the 485 was submitted on July 22 2016 and use that date to determine review timing.

Hoping to find out if I should expect to wait a couple of weeks/months or a year plus for the AOS and Green Card.

Thanks!

They are adjudicating in your area the I485  received in August 2016, but your case is still with VSC it may take 20 days to ship your file to NBC and NBC takes 30/60 days to ship to the local office, that being said you will have to wait long time to have the interview (8/10 months).

Folks, one guy that I helped with his VAWA and AOS, he is a visa jurney member, he received his  green card  today without an interview and without submitting a waiver of inadmissibity. He needed an waiver to overcome some inadmissibility but USCIS did not ask him the waiver. He called me early morning today to tell me the good news.

Hey all,

Today they updated the I-360 processing times for VSC. They are saying that: as of March 31, they were processing cases received as of May 20. This is only 11 days worth of progress from last month's figures where they said that: as of Feb 28, they were processing cases received as of May 9.

My question is, how can this be when forum members are stating approvals received this month (congrats btw) from cases filed in late July?!

I filed in Mid-August 2016 and am so fed up with waiting, I have taken to over analyzing the posted dates to try and coach myself through this process and keep my sanity. How much longer do you think those of us who filed in Mid August will have to wait?! Thank you in advance!! :)

Sandra, Can you share any details for timing with this case?

I mentioned the possibility of no interview request for a 485 in an earlier post today. I know it is rare and unlikely however you have an instance of it happening. Great news for you and your client!!!

I am in a similar situation with inadmissibility, however it is my understand that a VAWA approval will most likely wave any requirements for an inadmissibility waiver.

If you can share his timeline that would be greatly appreciated!

Bests!
