Timeline

I filed my vawa on Nov 8th 2016, and today the status changed to : received correspondence and USCIS IS REVIEWING IT. I didn't send anything and I don't have a lawyer so am wondering what this means?

Peru1234 I remember you mentioned your package was delivered Dec 31 so you should wait to Jan 31st you still don't need to worry for another week. If you don't get it you just call with your tracking info to ask, they may explain why it's late (don't expect a receipt number given to you over the phone) they will probably look into it & give u some explanation! I hope you get it before then xx

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

01/31/2017 EAD update (Ordered my new card)

02/04/2017 My first EAD delivered.

02/06/2017 Picked my EAD & applied for SSN

02/14/2017 Applied for state ID

02/15/2017 Applied for Medicaid

06/03/2017 Received my Prima Facie (180 days)

10/22/2017 Mailed EAD Renewal  & AP & Waiver (I-765. I-131, I-912) and request to extend PF

11/05/2018 Completed the medical (I-693)

You don't need a lawyer. You can file it on your own. Having a lawyer may be helpful but most of what these lawyers are doing, you can do on your own. I filed my i360 and all my forms by myself

It does not matter if it is a heterosexual or homosexual marage. Men can file for VAWA as well. As long as you are in an abusive marriage you can file and hope for the best. There are never any guarantees you will get approved.

 

I have researched alot about VAWA after filing it to kind of get some kind of confidence in the outcome.

 

You qualify if you:

 

- have proof of the abuse (police reports, 911 calls, affidavits, pictures, texts, emails anything you have)

- can prove that this was a bonified marriage (marriage certificate, wedding pictures, affidavits, photos and etc)

- can prove that you resided together (bills with your names, joint bank accounts, mortgage and etc)

- proof that you are a person of good moral character (affidavits, proof from the fbi or police of a clean record, volunteering and etc)

 

One of the most important things you need to include is your story. Start with how you fell for one another and the good times you had. Explain when the abuse started. Go into detail and do not lie.

 

Mind you I am still waiting on my approvals, but that is what I included. And I feel pretty confident since there is nothing I could add at this point.

You didn't include proof that he's a US citizen? Isn't that required?

I would advice you to go to the interview and explain to them. Tell them that you are in the process of applying for i360. They will most likely have you put it in written form at the office. I once Had an interview in the past where I had a dispute with my spouse and he refused to show up at the last minute. I went to the interview alone and told them what the problem was and why he didn't show up, they told me to put it down in writing and request a rescheduling, which I did. Interview was rescheduled. In your case, they would ask u to write and request a postponement/abeyance on your case while your i360 is processing.

Hi hopeful diva, have you heard anything from them yet and if you don't mind can you post your timeline? Has you case been approved?

Of course, you need to provide proof that a person is a US citizen or a legal resident in the United States.

I-360 filed - 10/21/2016

berryseed you need to know the reason why your AOS was denied, if it was because you couldn't prove bonafide marriage then you should not have a problem with your new I-485, but if the reason was a sham marriage then forget about it because USCIS will not approve a new AOS at all.

 

I remember 3 cases of VAWA/AOS denied because of sham marriages and their new I485, because they got married, were denied as well.

For some of you who sent your applications around December 21st - Mine was sent on December 20th through Express Mail and I am still waiting on my receipts so you guys are not alone. It seems like there is a delay due to Christmas/New Years Season. I am sure they will be coming any day now ☺

Did you at least get a receipt notice?

but i read someone they have prima facie? But i dont have it yet
