You said you came to USA in Dec 2016 and got married same month. Did you enter with K1 visa? if you entered in the U.S under the visa waiver you might have  a problem with your AOS to prove bonafide marriage and specially because you got married  days/weeks after arriving in the U.S.

Hi sandranj,I am working on obtaining all documents needed and then will go to shelter. I arrived in dec 2016 on a K1 Visa. Will I be okay? Another question I have is he intentionally broke my eye glasses the day he strangled me  and I don't have anything else to rely on in order to see as my eyesight is bad. He is refusing to get me a new pair of glasses because he said he has better things to do and i don't have money or insurance. shall i include a photo of the broken glasses in the packet because I read somewhere that if abuser has destroyed property you should include that too?

Or there is some specific form? And how many affidativez from family members and friends to pride bonafide marriage ? 

And should I give to my layer original cards, bills or copy will be enough?

Hahaha, it reminds me my situation for two years he couldn't find a time to send a letter to insurance company to get me insured, I had problems with period one month it was going two times a month and I asked him to wake up early to call insurance to ask about why they didn't sent it first time when he applied , maybe he didn't sent some missing papers , and he was sleeping all day , waked up when insurance was closed and he said me what u think the world is spinning around u , I have too much stuff to do then ur insurance , and was keeping sleep till 6 pm.

@Pinkrlion It's useful to have prima facie to apply for public benefits, Medicaid, FAFSA and SNAP.

I needed to see a doctor also and had to wait for my prima facie which and then my EAD to apply for SSN to get Medicaid without a hassle!

 

@MsBoo While it's good to have Prima Facie to validate your qualification, you may still be able to apply for Medicaid over the phone anyway since your SSN is available just choose in the questionnaire (immigrant) since your AOS is pending and you have valid status! it depends on how informed and helpful the employees are!

Yes you should include pictures of your destroyed property. When my estranged husband smashed my laptop on the floor and broke it in a fit of rage during one of our numerous arguments. I took pictures of it and stored it on my phone. When I filed for vawa, I attached pictures of that laptop and explained in my affidavit.

But are we allowed to ask for and use public benefits if and when we have a valid EAD and can legally work? Will this not be an issue in the future? 

I can understand if one has an invalid ead and cannot work

You can submit the broken glasses pictures too. You should leave him NOW, do not endanger your life waiting to gather documents.

 

 

Do not mention to your husbnad or to his mother that you are leaving. When your husband leaves to work pack your belongs. Go to the police station or go outside and call the police, wait outside until the police comes,and  tell the 911 that you are  a victim of domestic violence and you have to retrieve your belongs but his mother  is in the gouse and she is very abusive too and you fear for your life and you need them to enter in the house with you. They will come to the house take your stuff and  ask them to take you to a shelter for victis of domestic violence.  Get a police report.

Survivors of  DV  can file for public benefits even if the person works. It will not be an issue in the future because the Law allows the person to do this.

Copies of documents are okay. Don't ever submit originals cos u won't get it back if your lawyer sends them to Vermont. But of course I believe your lawyer should know not to submit originals 😊

2-3 affidavits should be fine , maybe one of your Mum or dad, one from your sibling or cousin and one from a really close friend who witnessed your courtship and marriage. 

There is a format. I believe the format should be similar to the format that you would use to write your affidavit. I'll send something to your inbox for guidance.

Thank you for clarifying this. I just wonder why they refused to grant my Medicaid. In Maryland or at least in my county, they said Prima facie holders do not qualify for health coverage. Only 5 year LPRs can get it. All I got was SNAP 😔

I only said @MsBoo may apply for Medicaid over the phone and she has a valid EAD but her income may qualify her, Medical Care is bloody expensive you know?...  Anyway I am no expert on this but when I applied they didn't want my prima facie  (A#... or something)

I have a friend who applied for asylum and when she got her SSN she applied for Medicaid in person, and kept it until she got a good job with medical!

I suppose if you answer the questionnaire honestly and accurately as possible and speak with the employee you may find it easier than you think.

Lying & Fraud is what gets you in trouble, I suggested neither of course
