I am curious what kind of RFE did you receive? I have all documents for prima facie but zero bills and such , my husband made sure of it . He kept a po box where even my immigration documents were sent to . Also if i already have a i130 pending for 12 months and transferd 3 time ? Will the filing date be transferd to my vawa petition?

Does anyone here have experience with vawa cancelation of removal ?  Im asking because i have a pending deportation case and i read that is an option and that the judge would have jurisdiction over the AOS.

But if you didn't receive PF and don't have the blue sheet, then just wait until they ask you for more info on good moral through an RFE. I submitted police clearance from my country of origin as well as a state wide criminal background check from my current state of residence in the US. If you have lived in the US for more than 3 years prior to filing for vawa, then you probably do not need to submit a clearance from your home country.... If less than 3 years, then yes you do 

Thanks @Hopeful diva I did receive Prima Facie. I will submit the documents using the Blue forms as you have suggested.

I did my biometrics with my first AOS application with my husband. I even got as far as the green card interview. I did another one last month for my VAWA petition. I filed vawa September 2016. So far I've not gotten any RFEs. 

 

Should I still submit police clearance documents or wait to see if I get an RFE for it? Should I get one from my home country or just for the states I've resided in since being in the United States?

 

Please help.

 

If you have lived here for 3 years then you don't need to submit police clearance from abroad.

 

Do not submit any document if you did not receive an RFE .

USCIS cannot adjudicate your AOS if your removal proceeding is open.  After filing VAWA It's advised that you and the USCIS sign a joint motion to administratively close proceedings, once the removal is close then USCIS can adjudicate your AOS, but you have the option to file  Form I-485  with the immigration court as well, after VAWA approval.

 

You must explain in details in your affidavit why you do not commingling finances.

 

Ther spouse of a U.S Citizen is considered immediate relative and there is no priority date, just for spouses of a green card holder.

 

If you got married after you were placed in removal proceedings then you have to file a "Request for Bona Fide Marriage exemption section 204(g) under INA § 245 (e) (3); 8 C.F.R. § 204.2 . USCIS or the Immigration Court cannot adjudicate your AOS if you do not file the exemption letter.

I don't think she needs to wait for an RFE. On the blue sheet that comes with our prima facie, it's boldly written that we can submit more documents with the blue sheet attached while our petition is pending. I have also done this 2 months ago and had no problems, they received my correspondence and added it to my file. 

I have also not received an RFE since I submitted my i360 in January

Greenspirit if you dont mind could you share how you ended up in removal proceedings? Did ICE just come to your door? Anyone else who is/has been in removal proceedings please share if you dont mind, thank you.

Hi @sandranj Does this also apply for those who were granted witholding of removal prior to the marriage? I only filed I-360 with Vermont and then when approved plan on filing motion to reopen and then file my I-485 with court/judge

Hi. What is better to choose pro bono layer or private? I went to family justice center and they give me an immigration layer and layer took my case just asked to bring some papers to start the case like pictures, some checks that he bought me jewilery and some receipts from packages that my mother sent us and greeting cards , after this she said we can start doing wava . but I have difficult situation with my IDs. I lost some of them. Which layer would be better? Private layer quite expensive but I can't try borrow money from my friends . but o don't know which experience these private layers have, I was consulting with three private layers. Plus I don't have my husband's birth certificate, and oder online u need his mother maiden name, and I don't know his mother maiden name, she died several years ago.

Pro bono lawyer or otherwise, I think it depends on ur choice and how deep ur pocket is. 

Pro bono lawyers are as good as ur private lawyers, they all do the same thing. Now it depends on ur confidence in which ever one u choose.

if u have the option of not paying a lawyer' fee then why would u wanna pay since u stated that u might have to borrow from friends?

Today 1 month now since they transfered my EAD from MSC to Vermont  in order to speed up the process to renew it.

Take too long does anybody experience it?

Yep! They transferred mine last month as well from my local office to Vermont. May 13th will make it a month. I noticed they touched my i765 yesterday. Last update was 05/10. So guess they are probably already working on it. Fingers crossed for an approval soon

Hopeful Diva  I  advise not to submit any document WITHOUT THE BLUE SHEET (RFE)  because 7/8 out of 10 documents submitted to USCIS, without the RFE, are misplaced/disappear.

 

One girl here on Visa journey gave her medical exam to the IO when attending interview 2 weeks ago, this week she got an RFE asking the medical exam, it means USCIS disappeared with her medical exam. I saw at least 20 cases that people submitted the medical exam without RFE and the medical exam disappeared and hundreds of documents submitted without an RFE just vanished. USCIS has contractors, they are not immigration officers, they work in the mail room, they are instructed to put every document accompanied by the blue sheet(RFE) with the application, but when people submit unsolicited documents usually these documents never make it into the application.

 

We cannot follow just what USCIS says.  For example, the Immigration Law states to change the AOS address the person must file form AR11 right? well USCIS  screws up most of the time and do not update the address despite the applicant submitted form  AR1, then I often tell the applicants to file for AR 11, wait 10  days and go to the infopass. 

 

You submitted documents without an RFE and they placed on your file, but we attorneys do not advise to do this.
