11/5/2016- RFE received (Bonifides, Criminal History clearance)

1/7/2017- Responded to RFE

5/9/2017- Approved!!

Though she did inform me the burden of proof would be higher with BONAFIDE exemption request.

She helped me with the template identifying the proper law to cite and links that truly helped. GOD BLESS SANDRA!

 

You're post is giving me a lot of hope as my husband locked me out of the house and didn't even allow me to get my clothes, lucky I always kept my passport in my purse so I had no photos or physical proof of bonafide marriage other  than my own declaration & affidavits from friends who witnessed my humiliation and abandonment.

The only proof of shared residence is only a single piece of mail in my name to our address, and I am praying not to get RFE as I have no clue how to handle it.

Timeline: 

May 2016 retained an attorney and started to prepare my VAWA petition. 

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

01/12/2017 Biometrics completed

Hey guys,

 

I just checked the online status on USCIS website and it shows that my case was just approved today. Here is my timeline:

 

05/02/2016 case received

05/16/2016 first prima facie

01/25/2017 second prima facie

5/10/2017 case approved

 

I did not receive any RFEs...

 

I want to specially thank @miloy001 for being so patience with me, answering my questions and explaining to me over and over again... and also I want to thank @sandranj for answering my questions and provide me advises...

 

Moreover, @armorcannon told me that she was approved today as well. If you applied around May 2016, please check your online status, you might got your case approved too.

 

Vawa is a tough and long battle to fight. Wish you all good luck with your applications.

Congrats to all who have had their VAWA petition approved. Praise be to God. A big thank you for all the members, who go out of their way to assist us. Angels don't always have wings. 

 

I did my biometrics with my first AOS application with my husband. I even got as far as the green card interview. I did another one last month for my VAWA petition. I filed vawa September 2016. So far I've not gotten any RFEs. 

 

Should I still submit police clearance documents or wait to see if I get an RFE for it? Should I get one from my home country or just for the states I've resided in since being in the United States?

 

Please help.

Did you receive prima facie? There's a blue sheet that comes with it, you can submit additional evidence with that blue sheet instead of waiting for an RFE. But if you didn't receive PF and don't have the blue sheet, then just wait until they ask you for more info on good moral through an RFE. I submitted police clearance from my country of origin as well as a state wide criminal background check from my current state of residence in the US. If you have lived in the US for more than 3 years prior to filing for vawa, then you probably do not need to submit a clearance from your home country.... If less than 3 years, then yes you do

Am so grateful to God for those who got approved, We thank God  for our members, with prays we will all get there. i want to advice those who got approved to try and stay in this forum so you can give people encouragement, like   @sandranj  if she is not here it going to be hard we all no it please don't run off we need you guys thanks

I will stay and courage our sisters on this forum to fight the battle and have more faith for the future, and I will update my future EAD and GC application too. Thanks a lot for you all to courage me a lot in the past. Stay strong and always pray for the best.
