Okay so i got an RFE today for my Aos package as i only sent an I-864 from my father in law (joint sponsor). I now understand i have to send another I-864 also from my wife (Petitioner). However, I am now thinking my father in law should have sent an I-864A and my wife the I-864??? Is this correct?

Also I am having a real hard time with the Household size part of the I-864 as we all live at the same address.

Any help would be great! :)

Does your father-in-law include either of you on his taxes? If not, you file an i-864 and he files an i-864.

Household sizes reflects the number for tax purposes, not for where you're living.

For example, when I submitted documents to the NVC, my technical permanent address was my mother's house.

I filed an i-864. My mother filed an i-864. My household size was two; my husband and I. My mother's household size was three; herself, my father, and my husband. I wasn't included in her houshold size and she wasn't in mine because we do not claim each other on taxes.

We didn't use a joint sponsor so I don't have first hand knowledge about it.

But, if instead you are just looking to combine his pay with yours to supplement the application, then yes, he does an i-864a and your wife does an i-864. Does that make sense?

Yes thank you! So i reckon that because he is the one providing the financial support and my wife is solely the petitioner then its an I-864 from each of them?

Yes, that is absolutely correct! Your wife will submit the i-864 and it will show that she does not meet the requirements. The i-864 that your father-in-law completes will show that he meets the requirements. For your wife's i-864, she needs to check the box that says "I am the petitioner." Your father-in-law will select the box that says "I am the only joint sponsor."
