Hello,

I am in the US and about to marry my fiance. I arrived to the US on an alien fiance visa. I am currently living in Ohio with my fiance. My fiance and I plan to marry (within three weeks) and then want to move to a different state (probably NY) within the next three months. After Marriage I have to adjust my status to become a permanent resident. My question was if it would be possible to adjust my status to be a NY state resident immidiately?

Any help is appreciated. :help: Thank you.

You will need a permanant address so if you have one in NY State and that will be your home then yes you can file under that area but other than that you will have to file where you are now and use the change of address form AR-11 once you move.

Just remember that changing while cases are processing can be a bit weird and problems can and do occur. ie currently I had to move States whcih changed my District office, and now Im getting weird descheduling interview letters emailed, thats fine but it would of been nice to have an actual interview letter. Im going to an infopass next week to find out whats going on.

So if you can wait until you move before you file AOS if you dont need to work straight away, that might be the better way to go.

You are adjusting your status to be a permanent resident of the country, not a particular state. Each state has its own residency requirements that have no effect on your AOS. You are just going to have to deal with the change of address issues and hope all works out smoothly.
