So you were in favor of the Obama bailouts that prevented the auto industry from collapsing, banks from going broke and people from losing their homes?

You know, in a way bankruptcy is kind of like what some anti-abortionists call a 'crutch' to get out of accepting your lifestyle and taking responsibility for your actions. There are even serial bankrupters too.

You won't see it that way of course. But it's a little ridiculous telling a poster they are an idiot simply because they have strong moral principles that involve taking responsibility for their financial decisions.

Well, respectfully, I disagree with all 3 of you :D

In regards to famous individuals that have filed bankruptcies; You can't really compare business related bankruptcies and personal ones. Most of the people on the list had to deal with personal bankruptcies which might not be fine with Val but they are fine with me. Alot of people end up in that situation sometimes, hell I even almost did once(it was a long time ago back in Israel and luckily I was saved by a friend who trusted me with 25K, and got it back with dividends). Even though I didn't end up going through with it, the whole experience definitely made me alot stronger, smarter and better just as I'm sure it was the same for alot of those people. So I think for some it can end up being a very important process and to me it's more than getting out of paying debt; It's the opportunity to make certain sacrifices in order to get a second chance. Business bankruptcies = zero personal accountability.

However that said, you also cannot compare it to abortions. Abortions are a personal decision someone makes in their own life; When it comes to a business decision and again I'm not necessarily condoning it - if he didn't file for bankruptcy he was basically going to put himself in a disadvantage against other business people. If the law allows you to do something you bet most would take advantage of it, whether it is moral or ethical to some or not. Knowing that alone could be the reason for you to do it as well, otherwise you are knowingly giving others the edge over you.

As far as the bailouts go - to me bailouts are the exact opposite of bankruptcy so again not sure about the comparison. I was always against bailouts btw, I was against them then, I am now, and will be in the future. I think they should have just let them go bankrupt, but they didn't, instead they bailed them out.

Dealership in Kansas goes bankrupt, Joe Car Salesman is unemployed, and Ford factory in Michigan is forced to lay Joe Whatever off. Joe Car Salesman and Joe Whatever lose their jobs, they can't afford iPhones and plumbers. So Joe the Plumber and Joe Apple Store lose their jobs. Who's going to pay Joe the Plumber's mortgage and Joe Apple Store's rent? So Chase loses money.

Serial bankruptcy filers will learn that their protection from creditors will now last only 30 days, if the debtor had previously filed for a (dismissed) bankruptcy within the preceding 12 months. Even better, there will be no bankruptcy allowed (and no protection at all from creditors) if the debtor had more than one previously dismissed bankruptcy within the preceding 12 months.

Prohibitions on Refiling:

While the specific definition of serial filing may be slightly amorphous, the Bankruptcy Code does address timing prohibitions on refiling. A debtor cannot obtain a Chapter 7 discharge if he has obtained a discharge in a prior Chapter 7 case filed within the past eight years or a Chapter 13 case filed within the past six years. The time periods are measured from the commencement of the bankruptcy cases. Additionally, the automatic stay is diluted in its impact and effect for serial filers. As such, the automatic stay will last for only 30 days if a debtor's bankruptcy case was pending in the prior year but was dismissed. The stay will not even exist if two or more cases were pending in the prior year but were dismissed.

i don't have a problem with an individual that needs to file bankruptcy. if i personally ever had to file bankruptcy, i would do it with zero shame. douche canoes like trump spread their money out over various names/brands and one fails they allow another to absorb and let a license go. a personal bankruptcy only affects the filer, a business filing can cost jobs and affect hundreds of lives depending upon the size of the business/if it is absorbed or shut down, etc. i understand that trump/big business has a shaky relationship with ethics.

but if i personally ever had to file bankruptcy, i would do it with zero shame. same as collecting unemployment. i've had one opportunity to go on unemployment in my life and i took a bs job just to stay employed. i cheated myself out of benefits i'd been paying into for years. i would have made more money on the unemployment but i was more concerned with being employed.

And she was actively looking for a job, well within the bounds that the government allows, so not trying to be a freeloader or anything. I was there when she opened the envelope that contained her first bi-monthly check. Tears sprung to her face as she looked at it. I thought she was overwhelmed because she could now buy food for her kids. Instead, she looked at me and asked, "How can I buy food when this won't even cover the rent?" Yeah, it was less than paltry. Luckily, she got a job very soon after and never really had to depend on the subsistence.

but if i personally ever had to file bankruptcy, i would do it with zero shame. same as collecting unemployment. i've had one opportunity to go on unemployment in my life and i took a bs job just to stay employed. i cheated myself out of benefits i'd been paying into for years. i would have made more money on the unemployment but i was more concerned with being employed.

for me it was just a matter of being naive. the job i ended up taking was about six dollars an hour less then what i would have pulled in unemployment. and i paid into that unemployment for seven years soo it was really just a very stupid move on my part. i was sort of afraid if i stopped working i'd end up with a gap in my resume that would make future employment difficult.. valid fear.

I don't think a gap will kill you. I did not work for over 2 years, and got hired the first place I applied.

I don't think a gap will kill you. I did not work for over 2 years, and got hired the first place I applied.

Yes I was a Network manager for three years. I kept going into the Plant and fixing production issues, so they made me plant Manager.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
