I wonder if it has anything to do with this?

I don't think that has anything to do with it. This is delaying the paper receipts only. You can still check online at the USCIS website to see if you have had any touches or approvals.

It may still have something to do with:

The California Service Center does have a backlog since accepting many I-130 petitions from embassies abroad since enacting the Adam Walsh act.

As of January 22, 2007, consular offices abroad were instructed to cease accepting certain immigrant visa petitions because consular officers lacked the means to perform the required criminal background checks on American citizen petitioners, as required by the Adam Walsh Act.

All lawful permanent residents, and American Citizens resident in the United States or with a permanent address in the United States, must file I-130 petitions at the USCIS Service Center having jurisdiction over their place of residence.

Apparently California Service Center is experiencing the brunt of this and as a result is really backed up.

I don't know if this is still the case with the CSC.

On a side note my adjudication estimate has only increased by one day.

So who knows if this is the reason they are still experiencing delays but it is annoying that someone didn't have the foresight to see that this would be a problem and divide these extra petitions evenly so as not to completely bog down one service center.

The I-130 issue is really old news. There was some problem initially when the DOS did not have a mechanism in place to run the corrected criminal history checks for the Adam Walsh act component. The Embassy's are doing DCF again, albeit modified with a 6 month residency requirement. I know that there were quite a few sent back, but overall I think the issues have more to do with H-1B's and systems issues. Remember this is vacation time, and if an adjudicator has his "Box" of petitions sitting at his/her desk and goes on vacation, they'll sit until they return. Remember this is vacation time, and if an adjudicator has his "Box" of petitions sitting at his/her desk and goes on vacation, they'll sit until they return. One could also assume that all of the H-1B's need to go through NVC as well so the tidal wave moves in their direction at the same time.

I'm right there with ya. I guess it would be nice to keep them locked in a smoke filled room hammering away on keyboards, and hoping that they never take a break. You know sorta like a Petition Sweat Shop or something.

We can't check the status of our case as we posted it from Ireland and used a bank issued international money order.

we forgot to send the Statement of Intent and I just realized today that we filled in a 2 page G325 rather than the four page G325A.

She refused to give him the number of the receipt so we could check the status online.

I would recommend contact your senator and letting them know what is going on. Having filed out the wrong G-325A and not adding your letter of intent may result in an RFE(maybe not hehe but you don't want to chance it.). Better to get that taken care of now. I would contact your Senator today without delay since USCIS isn't being of any help.

Hey Wioombeen,

Thanks for the advice. I've heard/seen it mentioned a fair bit over the last few days for people to contact their Senator. Wouldn't they be too busy to look at a case for a fiance visa petition? In saying that, I think that anything is worth a shot right now. We'll try and get in touch with the USCIS this week and see where the land lies.

I'm kind of half expecting an RFE....IF they ever get back to us. Someone on here told me before that the USCIS are likely to deny our petition for our problems, but the USCIS said that it's most likely we'll get a slight delay in processing and an RFE at most. We're not coming from one of the "risky" areas, so we do have that bonus I guess. Also, we've been living together for two years.

7th July 2007 - We called the USCIS and were given our receipt number. We also signed up for the USCIS online service. Learned that our petition arrived on May 15th and last action was May 25th 2007 - Much happier

4th October 2007 - Petition Approved!!!!!!

24 April 2008 - Interview at US Embassy Dublin

17 June 2008 - Arrived back in US together

10th SEPTEMBER 2008 - MARRIED!!!!!

It may be different from state to state but here in Michigan my senator has a special devision dedicated to immigration. I have already contacted them as a preemptive measure and have already filled out the needed documents from their office. So if i do encounter any problems all I need to do is send them an email. their department was very nice and helpful and assured me if I do encounter any problems such as a denial or long delays to let them know and they will contact the USCUS to resolve the problem.

I don't know if it would result in a denial. I would think an RFE if anything. But I wouldn't wait around to find out hehe. Keep calling the USCIS, but also get a hold of your senator and let him know the situation soon so if you do get a denial or RFE they will already know your situation and be ready to act. Maybe you end up not needing him/her but in case you do they will be ready.

My fiance just called the RFE - line and all the woman could tell him, was that they're handling applications from Dec-06. When he said some Apr-07 had already received NOA2s, she was very surprised... Go figure!

She then said we have no RFEs pending, and that basically nothing has been done to our petition. So, so much for that then :crying:

So I called to see my status and they told me that I hadn't been processed yet, I was about a week out as they are currently working on April 2nd. I was stunned since I've never read or heard about them saying a date other than the 'official' date, but she went on to tell me that in about a week my case should be handled. So if she is correct, that is good news for all of us. Let's hope so!

OMG that is crazy she said that to you, and yeah it looks like your Cautiously in the green. Your NOA1 date is a few days after mine so maybe this is good news for me and everyone else as well. No touches here yet though. :crying:

So I have my yahoo email set up to send an SMS to my cellphone if i receive an email with USCIS-CRIS in the senders slot.

I just now got this alert on my cell phone so I ran all the way home to check my email.

Lets digress.

Recently before leaving the house I had to change my password on my USCIS account.

O.k. back to the present. Well...... the very recent past anyway. It turns out it was just them verifying that I had indeed changed my password.

GAAAAH hahahaha. *Ripping Hair out* hahhhahahahaha That's my excitement for the rest of the week haha. <_<

I have a friend who received a letter from NVC but didnt receive a copy of NOA2, no emails too, just 4 touches......they got their NOA1 last March 20.......hope it wont happen to me :no:
