Timeline
I'm helping my BIL with a k-1 visa for his fiancee from Cambodia. Just got word the US embassy in Phnom Penh denied the visa app with a 221g this morning. The box with "being returned to USCIS because the interviewer believes the marriage is a sham" was checked. :(

Next steps if any? Procedurally, where does this leave us? Advice?

I'm sorry that this happened to your friend. You may file an appeal once NVC recieves the petition denial. They'll send you a letter of denial for which you may file for an appeal. I'd recommend you to get an attorney who is very familiar with this process. Other than that, there isn't a thing you can do. An attorney is your best bet!

Thanks for the heads up. I'll pass this news on to my brother in law and we will get lawyered up.

I wrote out a long email to the US Embassy Immigrant Visa section this morning to see if they could give us another chance to show evidence of a legit engagement. They decided to marry when the brother in law was back in the US, and as a result they have not done the official engagement ceremony.

I explained in the email that it would be quite an irony (and a sham) to go through the engagement ceremony just to provide photographic evidence of the engagement, knowing the visa issuance decision may turn greatly on this evidence.

I doubt the email will do anything though, but worth a try.

It is times like this that really destroys your faith in our system of laws. When a legitimate visa petition is denied due to allegations of fraud and sham relationship, and yet people are able to stream into our country illegally and stay with near amnesty. Maybe we should spend the money on a coyote and bribery instead of following the honest way. [/rant off]

sent to the embassy.

So my fiance is still waiting for packet 3. Is that how the process works? the next step is receiving

the packet 3?

I would like to know ahead of time, what she needs to send in to get an interview date and packet 4? Is the form I-134 (affidavit of support) required to be sent along with the form ds-230 part I in order to book the interview or it's something that she takes along with her to the interview?

And also what are the required supporting documents for I-134 besides the irs 1040 if you've met the poverty line requirement as indicated on the 1040.

She needs to submit Packet 3 for the US Embassy to schedule an interview date in the form of Packet 4. I suggest getting the medical appointment early so you have one less thing on your shoulders. The places that does the medical are located in the Embassy Links within Visajourney.

Inside Packet 3, there is a list of documents to be attached with it. Know that the US Embassy set the appointment (packet 4) when they received packet 3. Within Packet 4, they lists the required documents to bring with her to the interview. Don't get ahead of yourself. Time will come. Good Luck!

Email them and ask for the Packet 3. They can email it to you as an attachment. For some odd reason they mail the Packet 3 over to you, the US citizen in the US which takes a very long time. If your fiance isn't familiar with filling out packet 3 she can pay for a service that does it for her.

This is what my wife use. She used them to translate her birth certificate as well and it got accepted during our AOS application. Although I've heard stories USCIS doesn't always accept translation from them. Good Luck.

As for the medical, can she just walk into the clinic that are approved by the embassy or does she

need to have some paper works with her? And does anybody happen to know how long the medical

report is valid for? Because we don't want to get the medical done and the embassy said it's not current

at the time of the interview.

I went to the embassy's website but could not locate their email at the "contact us" page. If anyone happen

have it, please post it here.

The medical report is good for one year. That's a garuntee. She can just walk into the clinic. Call the clinic beforehand to schedule an appointment. During the call, the clinic will provide instructions on what to bring. They do not need any paperwork that is required from the US Embassy.

As it turned out, they removed the email address from their website. I have no idea why they did that. Since you are in an immigrant visa case, use this email address IVPhnomPenh@state.gov

In my experience, I personally went to the US Embassy myself to pick them (packet 3) up. But, that's just me and I had the time and money to do so. The reason why they send it to the US Citizen address is because the mail system in Cambodia is not as reliable here in the US. Although, you may request via phone call or email to have them send it to your wife address in Cambodia. What I did for packet 4 was I had a request for the embassy to send it to my address in Cambodia. The delivery person was a moto-bike driver. We gave him five dollars tip for his effort. Boy, was he happy for that day making five dollars just for delivery. :rofl:

Yes, they sent Packet 3 to me here in the US. I had everything already filled out. When I did receive it I mailed the completed forms via USPS 6 day delivery. If you need I can send you the electronic version of what they sent me. Just let me know, and send me an e-mail address.

Just dropping by and say hello! I just got back from Cambodia and when I return I got RFE. USCIS wanted the "Marriage Certificate" in Khmer language. I sent them English but not Khmer. I guess I forgot. Anyway, I'm still waiting for my NOA2. Good luck to you all!

Many applicants forgot that they need the original copies as well as listed in the instructions in the form. I guess their location on the forms makes it less importance; therefore, nobody reads it.

They need to change the instructions.
