really confused about the date to file

Hello

im really confused about the date to file I751. :wacko:

the date my Immigrant visa granted was Dec 29,2014. IV issue date is the same as i see on the IV page inside my passport

the date I entered to the States was Apr 23,2015, GreenCard issue date is the same. Expiration date on GreenCard itself says Apr 23,2017

(also i still have the paper that i received from CBP officer that says, expiration date is Apr 23,2017)

now, When do i have to file I751 to remove the condition until?? until Dec 29,2016?

or Apr 23,2017?

on USCIS site, it says to file prior 90days before the card expiration date. so according to that, i thought ill have to apply until Apr 23.2017 which is from Jan 24,2017 to Apr 23,2017. but, i received the reminder notice letter from USCIS immigration service center saying "our record indicate that you entered to the United States on Dec 29,2014 as Conditional Permanent Residence(CPR). you must file I751 to remove the condition ~~~"

the date on the reminder letter is the date my visa was granted. not when i entered to the States.

which is correct?

when i seach on the net, most people says they filed by GC expiration date but i see some people filed by Immigrant visa issue date.

Has USCIS changed the rule about the date recently???

ive called USCIS customer service and asked few different representive(?), they all said they cant look into my record (information) since they dont have access to get into the system.. they suggested me to get INFOpass and ask about the date at the local office. so i went to the office and asked. then i was told to file by Card expiration date, not worry about the letter.. but i dont think he fixed the date on their system. so im still worried that they have wrong date on their system since the reminder letter has the wrong date (visa date, not card expiration date).

should i file by card expiration date as the man at USCIS office said?

what im worried that USCIS will tell me that my greencard is terminated after Dec 29,2016...If i file I751 after Jan 24,2017.

should i try to gather all the paperwork for Evidence and file I-751 before Dec 29 just in case? (i dont have all the paperwork now)

also, reminder letter was sent to my old address...even though ive changed address (AR11) on online months ago. so they might still have old address as my address not new address....

any advise would be appreciated.

It's the card expiration date that matters. You can only file once you've been a PR for one year and nine months, and you didn't become a PR until you actually entered the US. If you file before the 90 day window opens, you'll be denied.

If it isn't difficult, it isn't worth it.

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens

USCIS has been sending out reminder letters with the incorrect entry date on for a couple of months now. You can ignore it and file during the correct window. They've received many calls about it.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Hi vamos25,

Had the same letter based on visa issue date - was told to go by the green card date by many sources including USCIS officer when I called. Personally I would not worry about the potential "wrong date" in the system. You have the GC, a stamp in your passport and the piece of paper they give you at the POE all with the April date.

thanks for the info.

so like the USCIS site says then. i am still worried that they have wrong date and address,tho. but then not sure how to fix that.

so if i send a packet before Dec 29, they will deny, you say. isnt that mean that they would just send the packet back to me then i can send again to file before Apr 23? but all of you three says to file by expiration date on the green card itself so i think i will go by that..

I see. thats a big problem. when i called customer service center about the wrong date, they didnt mention that. they also couldnt verify me which date is corrent (when i need to file)... so i had to go to the local office to ask questions.

i hope they will fix the date on their system and resend the reminder letter with correct date.

thanks. good to see that some people have the same problem. so im guessing that you are going to file based on expiration date on your green card? and ignore the date on the reminder letter.

if USCIS tell me that my card is terminated or i was late to file I751, then i can show my green card, stamp in my passport, etc as proof.
