Timeline

I don't even know where to begin.Ive been here for 11 months and my life has been in shambles.Ive suffered physical and verbal abuse from my American husband,his 21 and 16 year olds have bullied me.My mother in law wanted to give me money to go back home when I cried on her shoulder after I called the cops.Ive sold my house and car before I left South Africa,I resigned at work and came to the USA after dating for 3years.I want a divorce but I don't wanna stay in America afterwards,no greencard.Guys I'm so helpless cause after contacting my family back in Africa it looks like I'm gonna be homeless when I get there.Im very depressed cos I loved this man,and burned my bridges thinking I have a future with him.If I go for my green card interview..I don't think I'll be able to hide my sadness and desperation to go back home.What are my rights as an immigrant wife?Do I even have any??

Do you want to stay in the US or go home?

You can divorce and file for a green card to stay based on domestic abuse, or you can choose to withdraw or abandon the green card application and go home.

What rights are you talking about? Rights to stay and live in the US? Rights to money in a divorce?

I'm so sorry this has happen to you. It must be very difficult making such a heart breaking decision. But I suggest that you should go to your interview. And be honest with the immigration officer. I believe they may have options for you especially you're suferring from abuse. Do you know anyone aside from your husband's family than you can trust? Maybe stay for them for awhile until you can clear your head on what's the next step to take.

I can't stay here,this place has been Horrible.Everytime I ask my husband to help get a place to live in at home (Africa)he tells me he doesn't have money.Im wondering if the law forces him to assist me get a place to just lay my head.No I don't wanna live in America

If you don't want to file VAWA to get a GC then your options are limited. Your husband is not forced by any law to help you find somewhere to live if you go back to South Africa.

Please be safe. If you are being abused, you should call the police and go to a shelter.

I don't know anybody except his family and friends whom are still very close with his ex wife,nobody can take me in.My mother doesn't wanna take me in cos my husband didn't pay the bride price/lobolo before he married me.

He filed an affidavit of support to take care of you. He is financially liable for you while you are here and until you are a US Citizen or it might be just for 10 years. I have not researched it in a while.

Go seek advise of immigration attorney to see what your rights are.

Sorry, your husband is under no legal obligation to help you buy a plane ticket or a home in SA. Any support would be determined in your divorce. Fighting over support will require you to get a lawyer which you can't pay for thus leaving you needing to find a pro bono lawyer.

Your best bet is to have friends or family from home buy you a plane ticket to go home.

I'm sorry to hear that! No one deserves to be treated like that! If you're not sure what is going to happen exactly if you back to SA you should study your options and stay in America if you can!
