Changing name at SS office problems.

Backstory. K1 visa from Hong Kong, 90 days expires December 18th, yet to file AOS, AP or work permit.

We went to the social security office a few days after we were married on 11/18/16. The man there asked if she had applied to work here and I said No, he had a puzzled look on his face and I believe he said DHS would have to clear this and we would receive her updated social security card in the mail in 3 weeks.

Today I receive a letter from SSA that read

"We cannot issue you a Social Security card at this time because:

Your legal immigration status and/or document(s) will expire before an SSN card be issued to you. Please contact us when your alien status changes, or is renewed, so you can work in the US"

You'll have to wait until you get your EAD.

If you had gone in and filed for the SSN a week after she arrived you would not have had a problem as you waited it is to close to the expire of the i94. You now have to wait to get the EAD before you can file. File for the AOS and in 90 days your partner can apply for an SSN.

I wrongly thought I specified, we already received her. Social security card. This was when we went to the social security office to change her name

You still have to wait for her EAD to change her name. Names in I-94 and SS card must be the same. once you received the EAD card with her married name on it, the I-94 won't be necessary.
