Should i withdraw my N400?

Hi all, hope there is someone out there with similar experience to mine.

Long story short:

Feb 2013 - got 2 year GC

March 2015 had interview for removing condition (we were separated and interviewed same questions) and in Nov 2015 got my 10 year GC. Since they took so long to make decision i met requirements to apply for citizenship.

Dec 2015 - applied for citizenship

April 2016 had my interview. Passed the test. After IO started grilling me for my marriage (all over again) I mean cmon we proved our marriage two times already, You guys already separated us and we proved it. oh well. Finished my interview with N14 or RFE. In May 2016 i sent all paperwork he asked me. no word since.

Lawyer sent online request for case status in August when 120 days passed and respond was We regret we cannot provide you with a time frame.

Im just sick of waiting and proving one thing all over again.

Should i just withdraw my petition and reapply in 5 years?

Anyone with similar exp?

If you were not living in a marital union at the time your filed for citizenship, then you were not eligible to apply

I think it would be best to face the officer who interviewed you. Make an infopass appointment and demand to speak with the officer who interviewed you, then nicely ask what is holding him/her to make a decision after 120 days and if there is anything else you could provide to help him adjudicate your application.

You can file suit in federal district court seeking to have a judge review your application since it's been over 120 days from your interview.

ITs way too much, i have no money for that:)

At the moment of applying and at the moment of interviewing we were living togheter. the fact we are (still) together lol

At the very least, I would say call your USCIS office or make an infopass appointment to try to find out what is going on, as charmander recommended above...

Husband's Naturalization Journey: (NBC number)

9/2/16: N-400 mailed to Dallas office via UPS Ground
9/6/16: Arrived to office per UPS tracking
9/14/16: NOA1 received in mail (dated 9/6/16)
9/21/16: Biometrics notification received in mail
10/6/16: Biometrics completed
11/10/16: Notification for interview received in mail
12/15/16: Interview ("Recommended for approval")
12/20/16: In line for oath ceremony (online status)
12/27/16: Received oath ceremony letter in mail
1/17/17: Oath ceremony
Hubby is now a US citizen! :) 133 days from NOA date to Oath Ceremony
