Applying for two different types of visa

Timeline

I’m applying for a CR1 visa for my husband. We are at the stage of collecting all the documentation to send the I-864 package.

But, a couple of days ago, my husband received a job offer to work in the US with an HB1 Visa.

Can this be done? I mean, can he be given a HB1 Visa while the CR1 visa is in process?

And how applying for an HB1 visa will affect our CR1 application process?

Any help is greatly appreciated.

HB1? Are you sure it's not H1B?

Though H1B is a non-immigrant visa, it does allow the holder to have dual intent.

No one can guarantee that the consular official will see it in the same way, but it shouldn't hurt to try. Just make sure you answer all questions truthfully, especially those regarding your I130 case.

05/17/07 Interview. Scheduled after much struggle with the 900 phone line.

05/17/07 K3 visa approved

If your husband has an H-1B job offer, was the application in today? The H1-Bs can apply April 1 for work beginning in October.

I imagine, based on where you're at in the process now, that he will be here much sooner, and as a Permanent Resident, by sticking with his current application.

But if you wanted to, it could be done. Your husband should speak with the legal department of his employer to find out what their opinion is.

i think if your partner sticks with his h-1b he can get Lpr soon

however you can take advice from a good lawyer
