Still no news on EAD/AP..but who cares?! We're schedule for our interview next month!! Wahoooo!!!!! :jest::jest:

Will try to figure this ITIN tax thing out in the mean time. Anybody know if taxes sent in with the ITIN will be counted late if they've been filed before tax day, but aren't processed before then (because the ITIN will take processing priority)?

You can amend your taxes once you get ur ssn

Thanks for your help with this bronx. To be sure I understand you correctly, you're saying send in taxes + ITIN together. Then, once we get the ssn (which will likely be before they process the ITIN) amend the taxes to include the new ssn?

Our journey applying to adjust status (while in the US) from a B2 visa as the spouse of a US citizen:

[day 0]   12/24/16 ~  USPS confirmed delivery at USCIS Chicago Lockbox

[day 1]   12/27/16 ~  Priority date (USCIS website's listed date of packet arrival)

[day 16] 01/11/17 ~ Checks cashed, and (4) email and (4) text message application acceptance NOAs received

[day 22] 01/17/17 ~ I-797 (NOA) x4 received in the mail

[day 25] 01/21/17 ~ Biometrics letter received in the mail

[day 38] 02/02/17 ~ Biometrics appointment (on designated date)

[day 46] 02/10/17 ~ "Interview Ready to be Scheduled"

[day 86] 03/22/17 ~ "Interview Scheduled" for April (USCIS website status)

[day 88] 03/24/17 ~ "Notice of Interview" official letter for April received in mail

@Mthldou @WI_CA Did your rfe case had a limit date , something like " you should receive a response by ...." ?? Also, were your Rfe considered "Initial Evidence " or just " Additional Evidence " ??

A tier 1 I had spoken to a while ago apparently had created a request for a tier 2 to call me back. I talked to one and they couldn't tell me when I should expect a response by.

@lleaka I really hope they get back to us soon. I also hope I sent them enough evidence. 3 years of the past returns...

Mathilde, I am beyond confused.

I had spoken to 2 officers, both assured me the case couldn't be set back to 0 . Now I receive a call from a tier 2 today, she tells me both the ead/ap + 485 are reset as a consequence of the request ( because it's "Initial ", not " Additional ").She even adds " even if you were to get a job offer, no point in expediting, you need to wait 3 months at least". I have no idea who is right/ what exactly is going on. There's no date limit as to when I'm supposed to get a response.

I've heard the same thing but everyone I've seen on here with rfie got their EAD way before the 90 days after they sent their responses. So I wouldn't believe what they say because stories tell a different story on here. They can't even agree on what Goes on either. I guess we can wait and see but I'm pretty positive it won't take another 90 days. Maybe another 2-3 weeks.

That's reassuring. The most frustrating about this all is there's never a straight answer, they all say something different at Uscis.

My case had been collecting dust for long enough, I just want to make sure it doesn't happen again.

Regarding the misinformation you got from the tier 2 officer, I would suggest you disregard the whole thing and you will probably receive your ead within 1-2 weeks.

USCIS love to momisinform people and from my experience so far, I can never get an accurate/ case-specific information from any of them.

Best of luck

If you haven't done your taxes as yet might as well he leave you off it then when you get your ssn you can go ahead and adjust it. Some places charge $120 to amend taxes. Seeing that your having interview in 4 weeks or less by the time the process the itin then process the taxes you may end up getting your ssn way before that.

What!!! I wouldn't take that as gospel. I have had friends who experience that and their case wasn't reset

We got an RFIE on our I-485.

We received EAD/AP combo card in 108 days.  Some who did not get any RFE or RFIE waited that long too. There has been all that talk about how RFIE reset the clock and RFEs restart the clock.  Personally, I don't believe there is any rhyme or reason to that.  USCIS will give that out as an excuse, but honestly, I think it just all depends on the adjudicator.
