Personal side note, I am going to apply for an ITIN on April 4th. We already filed our taxes, our h&r block tax preparer said how he filed our taxes was fine, and someone with 30 years tax eperiemve didnt know I needed an ITIN, wish we hadn't trusted him and researched it ourselves. So now we have to amend our taxes once I have an ITIN, the IRS penalized my husband by over $1000 because of it. 

However, I have no visa right now, only the Alien number and pending AOS, Im worried they wont give me an ITIN as thats not one of their categories. Eeek. 

My visa expired and I still can get an ITIN. Go see a certified agent at hr block and they certify your passport. They don't care about your immigration status because even illegals can get an ITIN. You will be perfectly fine with your aos status. They did not ask me about my immigration status at all actually.

An Individual Taxpayer Identification Number (ITIN) is a tax processing number issued by the Internal Revenue Service. The IRS issues ITINs to individuals who are required to have a U.S. taxpayer identification number but who do not have, and are not eligible to obtain, a Social Security number (SSN) from the Social Security Administration (SSA).

The IRS issues ITINs regardless of immigration status, because both resident and nonresident aliens may have a U.S. filing or reporting requirement under the Internal Revenue Code. They do not serve any purpose other than federal tax reporting. An ITIN does not authorize work in the U.S. or provide eligibility for Social Security benefits or the Earned Income Tax Credit.

Do I need an ITIN?

You must obtain an ITIN if:

1. You do not have an SSN and are not eligible to obtain one.

And

2. You identify with one of the following categories.

• Nonresident alien who is required to file a U.S. tax return.
• U.S. resident alien who is (based on days present in the United States) filing a U.S. tax return.
• Dependent or spouse of a U.S. citizen/resident alien.
• Dependent or spouse of a nonresident alien visa holder.

How do I get one?

Option 1

You can file Form W-7, Application for IRS Individual Taxpayer Identification Number, with your federal income tax return. You must also include original documentation or certified copies from the issuing agency to prove identity and foreign status. If you qualify for an exception, then file Form W-7 with your proof of identity and foreign status documents.

Based on Section 203 of the Protecting Americans from Tax Hikes, ITIN applicants residing outside the U.S. can only submit their W-7 directly to IRS.  Mail your W-7, tax return, proof of identity, and foreign status documents to:

Internal Revenue Service
Austin Service Center
ITIN Operation
P.O. Box 149342
Austin, TX 78714-9342

You will only file a tax return to the address above once, when you file Form W-7 to get an ITIN. In subsequent years, when you have an ITIN, you will file your Form 1040, 1040A, and 1040EZ as directed in the form instructions.

Option 2

You can apply for an ITIN in-person using the services of an IRS-authorized Certified Acceptance Agent or make an appointment at a designed IRS Taxpayer Assistance Center. This will prevent you from having to mail your proof of identity and foreign status documents. After processing, the IRS will issue your ITIN through the mail. 

Some VITA sites offer CAA service to taxpayers along with their VITA program.
 

When should I apply?

You can apply for an ITIN any time during the year when you have a filing or reporting requirement. At a minimum, you should complete Form W-7 when you are ready to file your federal income tax return by the return’s prescribed due date. If the tax return you attach to Form W-7 is filed after the return's due date, you may owe interest and/or penalties.

How long does it take?

You will receive a letter from the IRS assigning your tax identification number usually within seven weeks if you qualify for an ITIN and your application is complete.

I also raised a SR for my EAD two weeks ago and got a generic response. However, he said that I should receive it very soon. (Taken with a grain of salt).

Today I was finally able to get the call back from Tier II officer. Basically he told me the same thing as yours, @Bahamaboy   

 

My case has been ready to schedule for an interview, but not updated on the site. (Boy, how I want to believe in this tier II officer's words!) :dancing:

 

In regards to my SR (not assigned) and EAD, she said they are back logged and the timeframe is 75 to 90 working days. She said I should hear back from them next week. Back to waiting game :pop:

Note : Itin is linked to current tax return , they need to be sent together. Itin is issued in 6-9 weeks and then the tax return is processed ( additional 4-8 weeks to get a refund).I would call IRS and talk about your particular situation, taxes are serious business.You need to have a clear understanding of what to do.

My husband spoke to an IRS officer and he told him he could call them back when I have an ITIN and have the already completed tax return amended. I do believe this is not standard practice, Im thinking that perhaps it is due to the h&r block man being at fault, not sure.

Hmmm, thank you. That's reassuring. 

I'm wondering though if the case will be the same if I go to an IRS office to get my passport certified and hand in the application? 

Do you know if H&R will certify the documents for a w7 without a tax return? Doing it this way seems uncommon as we already filed our taxes.

Odd question, but I was eondering if the biometrics is for both the EAD and I485? I believe biometrics is needed for I485, yet my biometrics I had done is for the EAD? Im confused.

Hr block had a certified tax agent so they certified my passport and I didn't need to send it in. Just call them and ask. It can vary per location.

Yes, it is. It was specified in my NOA. It's a good idea to double check yours

Thank you! That's why I posted here, to give people some hope! I was so sad that I had no updates, when in fact it's probably just a lack of communication on their side.

Did you get your EAD in the mail as response to  the SR or was that a different update?
