Okay, so after hearing what most people here did towards the taxes I am filing for the ITIN with my husband's taxes. I am going to the office tomorrow in order to get my ID verified, and the lady on the phone said I need to bring in a filled out W-7 and a filled out tax return. Do you think it's okay that it is my husband's tax return and not mine?

 

He'll be at work so he can't come with me, do you think they will accept it? I really should have asked this on the phone, but I didn't think of it until afterwards. I will also bring in our marriage certificate (I basically bring it everywhere anyway!)

AOS Package sent: 12/20/2016

NOA letter received: 01/13/2017 (dated 01/06/2017)

hi,

I received an I-797 NOA today for my EAD saying it's approved (this is based on adjustment of status). The notice date was March the 9, 2017. In the letter, it says that my EAD was sent under separate cover to the beneficiary.

Hope you will get some positive news this week too.

Yes it did, first the I765 then an hour later the I131 changed too, am so happy can't wait to receive the EAD card so I can apply for my SSN and pass my DL.

Hopefully will get the card  this week I applied to work for a big hotel in LA two weeks ago and got called to come back for the second interview, let see if they call me for the final one lol.

No it wasn't. Only 2016. 

Mmh husband was a student all the way until April of 2016 when he started his new job. 

2015 tax returns weren't enough but we filed in 2015 with pay stubs for the past 8 months and letter from employer. 

Rfe in January about wrong household size. I fixed the issue. 

Now another RFE saying his income isn't high enough (when in fact it is by several thousands ). So 2015 return didn't not have enough but 2016 definitely does. I don't know what to do.

Yes, it's okay. Depending on how you file, it's either a married filing jointly ( what we do) or something else. Either way, they need your husbands tax return since your Itin is based on you being a Us citizen's spouse.

Can't you add spouse parents ?

If you see the explanation in the Rfe , it should say " qualification for a sponsor is based on line 22 of tax return form, not gross income " , is your income on line 22 of 1040 enough ? It could be that you thought it was a gross income instead of total income.

Well for the 2016 return is says 25,789 adjusted gross income. So it's definitely enough. But not for 2015. His annual income is 26,767 which is what it says on his employment letter and what I wrote down on the annual income field.
