I called uscis to know what it meant since i hadn't received an email, the nice lady was so concerned she decided to investigate . She then found out it was a Rfe sent.She also put a request for a tier 2 to call me since she believes my case has been pending for a while. ( not sure about that).

 

To answer the other questions: I forgot to mail my MIL ( our co-sponsor)  latest tax return. So , yes I was expecting a rfe until tier 2 told me it was all fine, all smooth.

 

I do remember reading about someone getting theirs past the 90 days , I believe it was on VisaJourney too. Hence why I have been pushing to have my case looked at, I had a feeling I would be next !! 

The tax return is a mandatory document. You would have gotten an rfe regardless. The officer you spoke to most likely just saw that one had not been issued thus far. It just means that they hadn't looked at the whole case to adjudicate it yet. Sorry about it though... sucks that it takes them so long to issue it.

Already responded to the RFE. What's weird is that my husband got an email with another receipt number saying 765 is approved. But not my receipt number. Idk what happened

I'm expecting an RFE as well and haven't heard anything yet, case status still says fingerprint fee received and I talked to customer support a couple of days ago and they saw no RFE in the system yet.

 

My received date is December 23.

Another K-1 filer in the December AOS thread got an RFE for more proof of income, he was way over poverty guideline and self-employed. He had sent in all evidence he could think of, tax returns, bank statements and so on.

 

We are in that exact same situation, so if they got an RFE we might too.

We are in that exact same situation, so if they got an RFE we might too.

I see.... they might have filled out some things incorrect as well thought to get that specific rfe.. so don't be 100% sure of that... You fill in the form with AGI instead of GI when you are self-employed for the annual income part.... but many fill in GI by mistake as self-employed...

Also since that is a matter of discretion of the adjudicator, you might get lucky with the adjudicator... what possibly could happen is them asking for the 2016 return, I suppose..

True, just because they got one doesn't mean we will, but it could very well happen. We just have to wait and see. If there will be an RFE I prefer that it takes a while so my husband has had time to file the 2016 taxes, that way we can send that return as well. We never sent any proof of assets since he was way over poverty limit, but in case of an RFE we can send that too, bank statements that shows how much we actually have. 

 

At least I feel very confident we have enough proof to send in case of an RFE, they will definitely not require a co-sponsor which feels good.

So I called Uscis regarding my service requested since online it stated that is was completed. I spoke to customer service and they said that a letter was mailed out to me today and it states that my case is under review with xyz and I will get a response shortly.

 

what that means I have no damn clue. I asked if there were any rfe she said no and if there was one it would have been sent in the letter she just read.
