I dunno much about the process but it helps if you will talk to a tier 2 officer. Though many say that they don't do much of a help, but it's always safe that somebody has to take a look at your file and forward something to someone.

 

When my checks weren't cashed out last december after a week, I spoke to a Tier 2 officer. He's very helpful and offered to monitor my account. Indeed, they were cashed the following day. 

 

And when I was worried about the status of my EAD, I also spoke to one tier 2 officer and though he said he can't do a service request as it is just 56 days from PD, he cared to forward something to someone to check on it and see what they could do.

 

Tip: just be polite and make yourself sound like you are deeply in need of his service. It is really effective. It worked for me, i am hoping for yours too.. ?

I am pretty sure you'd get yours real soon. I was informed by a USCIS officer that Santa Ana field office is very up-to-date in processing petitions. 

 

I called 3rd week January and they said they were processing April 2016 filers.. Called 2 weeks after and they said that they are then processing August 2016 filers. What a big jump on dates right? 

 

Just have faith and one day, yours will just arrive unexpectedly. Swear! ?

Thanks for the advice! What do you say to the rep on the phone? That you want to talk to a tier 2?

Yes. Tell them right away that you wish to talk to a tier 2 officer after you give them your receipt number. They won't resist it. ?

I got married January of 2016, but wasn't able to file because of the 2-year home residency requirement rule on my J1 visa. Not to mention that this year with the fee increase, everybody was rushed to file before 12/23.

Hi I see that you were adjusting from j1 and you got a waiver. My friend also got a waiver but he's wondering how does he file now. Is there any special way or is it best to use a lawyer

Hi,

 

My final recommendation from the USCIS is still pending. Per USCIS regulations, if someone is going through a No-objection waiver, you can file AOS once you get the DOS favorable recommendation. 

Just attach their recommendation to the AOS package.

The final USCIS recommendation is usually delivered in the form of adjudicating the AOS.

Note 2:  
A “no objection” case is the only situation where the alien is allowed to file an adjustment application concurrently with waiver request.

 So I just got off the phone with the National support centre and they told me that I should have an EAD decision by day 75. We are now at day 67 so looking at next Tuesday! I really hope so because I'm ready to get to work and get a move on with this process.

 

Can anyone else attest to the 75 day guideline?

Hi Jabbie,

 

Most of us have been waiting for longer than 75 days ( im just a few days past that) so I don't know if that's true. Most filers seem to get theirs in 82-100 days, I've seen longer on the November & October forums !!

The average for an approved EAD hasn't been 75 days in a loooong time. Before we filed it used to be 90 days, but now it seems like it might take a bit longer than that. Seems like 100 days is the normal now.

They gave you a generic reply. There is no such guideline. Basically if you dont get it within 75 days of your priority date you can urge them to look at your case for which the stiplulated reply might arrive anytime in the next 3 weeks. 

 

Basically 90 day from Priority date used to be a given, but recently even this number has been stretched to 95-100 days, if you look at october2016 and november 2016 filers.

June 23, 2020: Credit Card Debited

June 24, 2020: E notification for case (LIN-Receipt) 

July  15, 2020: Case was updated to show that fingerprints were taken

This wait is really agonizing. (I have not received any RFE).

Have faith.. might be that you are still undergoing some background checks which make it a bit delayed. 

 

I was told by a Tier 2 officer that if you came in through a K-1 visa, the background checks are not that much comprehensive since they have done it at 129-F level. But if you file your I-485 alongside an I-130, it will be more comprehensive and might take longer.
