As you can see on top of this thread, this thread is posted in the forum called "Adjustment of Status from Work, Student, & Tourist Visas". 

 

If you're adjusting status from a K-1 you should be in the subforum called "Adjustment of Status (Green Card) from Family Based Visas".

Hey Everyone, I think I was in the wrong thread for my AOS, so here I am here now as I am adjusting status based on marriage but from a tourist visa, not family based. 

This is my timeline so far: (I can't figure out how to get it to show in my signature)

Filed AOS and I795: 12/22/2016

Case received sms: 01/17/2017

NOA for both: 01/21/2017

RFIE: 02/13/2017

Biometrics Appointment:02/16/2017

RFIE received by uscis, case reopened: 02/17/2017

 

We also was asked for the most recent years tax return and request for a co-sponsor/assets for not meeting the income requirements in 2015 despite sending pay stubs and an employer letter, so am happy that we have 2016's tax return done. They also asked for my I-94, which has expired but I think i might've accidentally not sent it or a print out with an expired date. 

 

Now more waiting. 

 

Good luck everyone, and hope you have news soon.

Was the income you listed at first enough or did you have to change your sponsor for the RFE ?

It's a bit complicated. Our 2015 tax return wasn't enough income but my husband changed his job halfway through the year and so his income went up to above the poverty level. We sent them pay stubs but because it wasn't a full years he also got a letter from his employer. 

So the RFIE requesting a joint sponsor/assets was possibly because of that, but they also requested the most recent tax return which is 2016's which shows he earned enough anyway. I feel lucky that we were able to send the 2016 tax return, as we were unable to get a sponsor or save up assets. I was reassured that when I called uscis to confirm this, they said it was ok so long as the most recent tax return was enough income. Still, we are very nervous.

I'm just hoping that the chance to submit the new tax return with the RFIE will clear up any income confusion, so hopefully a blessing in disguise.

Okay thank you for clarifying! 

I actually had the same issue. Kind of. 

I made a mistake on the household size which automatically caused them to say the income wasn't enough. 2015 returns weren't enough so we sent the W2s from 2016 but we didn't file the actual return until later on after I sent the response. They asked for 2015. Income is enough with his current job so I sent 10 months of pay stubs and employment letter again to safe which states his yearly income as being well over the limit. 

I called USCIS as well they told me the household size or any mistake can cause them to say that the income isn't enough...even when it is indeed and you gotta point things out to them. 

Hopefully they like what we sent them. 

 

Even though they said 2015 was okay (I also forgot W2s the first time) I want to send the 2016 tax return copy to them.

In all honesty I think it will, as long as it shows that he makes above the 125% poverty line(in a more recent tax return). 

The change of jobs could have caused the problem.

 

Did you choose to send updated paystubs with job letter again?

Oh yeah, you do have a similar situation. 

The household size seems to be a common problem, I have to say they make that part of the forms rather confusing too. I hope they finally get that all right for you. We try to send everything and anything to help the process, I think if a case isn't simple and outside of the norm by anything small, they get can get confused so you're right to point things out, it can be frustrating. 

I hope it will all process smoothly for us now.
