It would appear you already have this intent to AOS before the child is here(USA), This would also appear to be visa fraud !!!

 

Per @Jboogie, they were "planning on moving fwd with consular processing" but "changed the nature of the petition from consular to AOS within the U.S?" after the child was here.

So he had no such such intent to AOS initially. This is legal.

 

Clearly, both cases are not similar

HIIIIII.. mY CASE IS APPROVED. on the spot the officer stamped approved. Didn't ask any documents to give,,,,nothing,...just ask questions from i485 to me and from i130 to my spouse and then asked us how did we meet. And I checked the status now it says new card is being produced....Yayyyyy

No i don't think that would help especially because the USCIS officers are very happy to point out the processing times from January 31, which in case of minnesota, petitions from March 23 are being processed.

 

Technically you can start bugging them once the date the applications are being processed have moved ahead as compared to your PD, but your case has not. Also what difference does it make if my background check is done or not, the matter of fact is they are lagging 10.5 months from PD for I-485.

 

So we just have to wait. Which just makes it a painful experience. <Sigh>

haha...you remember??? I am not even studying,, so happy for the green card  but I will review now

We have just come out of our interview and our case has been APPROVED!!

 

We are so excited. My wife almost had a panic attack in the car before we went in due to the stress of it all but it wasn't needed. 

 

We will do a full review later but we are very happy and my wife is gone shopping to destress.
