Some vj user DM asking what line or sentence made you unhappy on page 131. So I'll redirect the question to why You still can't or wont say what part of the post made you unhappy, or am i basically apologizing for filing AR11?

I agree, I read the post and couldn't find anything that could be taken as hurtful or sarcastic or anything like that. He keeps brining up you changing an address so I assume he's just bitter for not being able to do the same? Seems very strange either way.

We filed last dec15, 2016. They received it on dec22. Had our biometrics done on jan19. Ead card received around march 20. But I485 status still says "fingerprint received..." Just want to know if someone has same situations or any opinion or input would help a lot.

Mine is at fingerprint received too. And I talked to the tier 1 officer a couple of months back who was not able to say whether case has moved from NBC to local office or not either. I was thinking of calling and talking to tier 2 officer about the same but it seems that others have done it and have gotten similar abstract answers even from tier 2.

Timeline

Talking to a Tier 2 is the luck of the draw, really. Most of the time you end up with someone who claims over and over that s/he can't see anything, can't see where your case is at, can't see if you've been recommended for an interview waiver, can't see the response to a service request you filed, can't see the tracking number for your EAD or green card etc.

 

Then when you keep calling and end up with a Tier 2 who actually wants to help (they're few and far in between but sometimes you're lucky) you get the answer to all that and more. I assume that must mean the first category of Tier 2 I mentioned above are lying straight to your face, as I doubt different Tier 2 has access to different amounts of info.

Correct, The interview is for the I-485. However, Per info-pass info, the I-130 will go in the same file as the I-485. 

In a child filing for parent AOS, the petitioner (child) is not required to attend the interviewer, If you did, you can only go as an interpreter or so. Not sure you will be allowed to say much or they will have any questions for you. My mom was basically asked questions about the I-485 form she filled out.

 

Please note that most parents will get interview waiver. (so you may still get waiver even if you filed an AR 11) But interview waiver could take longer as they approved for such at MSC/NBC (national) level and not local office. ( once at local office = interview likely) how soon? depends on processing times

 

So I'd say "move to the mountain", if you may. For me, I was facing having to re-book flight for a 3rd time (at increasing cost) and the possibility of another medical I-693 due to submitted medical expiring before interview). So I gambled to switch office (As nothing is guaranteed with USCIS). But base the decision more from the conviction that St Paul field office was not going any where at least based on the data from USCIS website itself).

 

I'm just glad to share and maybe someone, someday may find this info useful too as I have benefited from VJ over the years myself.

Thank you so much for your good luck wishes and a detailed response. This info is extremely valuable to us, because we are in the same situation, doing AOS for parents from B2. And it is difficult to come by the relevant information, because most of the cases discussed here are marriage-based. I am sure more VJ members will be benefiting from your info. I don't think it's something that should be frown upon. It is a win-win solution. This helped USCIS too, in  re-distributing/optimizing their workload (they are doing that anyway from time to time, transferring cases to another office with less workload).

 

We are in the very beginning of our AOS journey. Our local office seems to be simply overwhelmed, and prospects of getting back in track do not look promising. We decided to send our documents without I-693 since it is almost certain that it would expire before we reach the interview phase of the process. So we have been considering alternative routes to follow in our journey, other than sitting here and waiting for more than a year for our interview, and have been thinking along the lines similar to your solution. We were not sure how things like interviews would work out with the petitioner and beneficiaries residing in different states, whether it would bring additional complications like traveling to another state for the petitioner or the beneficiary to attend the interview.

Regardless of same state or different states.

 

The interview will be for the I-485 only ( as the interview letter addressed to your parent should state) and not for both-130 & I-485. Your parent is the applicant (for the I-485 Application to Register Permanent Residence or Adjust Status). You should remember you are neither the petitioner or filer for this app.

The I-130 will of course need to be approved for the I-485 to be approved (or both concurrently approved as in most AOS cases) but you will not be interviewed for the I-130, Thus you as an I-130 petitioner is not required be at the I-485 interview.

Note : an I-130 interview for the USC petioner can be required in very rare cases before i-130 approval

 

You can definitely go to interview to act as a morale booster to your parents or interpreter if they speak or understand limited English. But you will not have any direct part in the interview. 

 

In a reverse scenario, parent filling for minor child AOS, The parent will have to be at the interview, same with spouse AOS petitions etc. But I can tell you as far as i know ,in your case, you are not be required to be.

Be mindful of loose misleading info/recommendations if you call USCIS customer care or schedule info pass so you do not stress out or incur unnecessary expenses.

 

If your parents are comfortable staying here as long as..., I'd say you can let the AOS app be and wait it out.

Mine came to visit, and is understandably homesick... plus patience is not one my virtues either :)

Procrastination on the other hand seem to be my BFF lol

July  15, 2020: Case was updated to show that fingerprints were taken

July 16, 2020 : Official NOA letter dated July 1 was received  

July 20, 2020 : Official fingerprint taken notice dated July 15 was received

March 05, 2021: Status updated to "Card in Production"

March 06, 2021: Status updated to I-751 Approved
