It's a good 2 weeks before NVC will have your case, then another 1-2 till you'll be able to get your case number.

Interview Scheduled: Jan 2nd - I managed to get someones canceled appointment the very same day my case status turned to Ready.

Biometrics: Mexico City Dec 27th Medical: Mexico City Dec 28th

Case says READY but consulate says case is not in system, I jumped the gun and booked an interview but they say its invalid until I receive the letter so I might have to cancel it.

Appointment Letter: Flew to Juarez just to get this, its actually 2 letters you need.

Interview Day: Jan 2nd   Interview Result: APPROVED

Tracking Number Received: Via email notice and website the afternoon of Jan 4th    Visa Delivered: Friday Jan 5th Mexico City

USCIS Notice - Green Card mailed: 3/28/18

yep, we applied for an I-130 from Australia dec 2016 and my husband applied and got an ESTA for travel in Jan 2017, and there were no issues, not even a question about our visa application- I think just have a return ticket

Thanks for sharing! So it was a "don't ask, don't tell" situation? As in your husband didn't mention the pending I-130 and the officer didn't ask?

yeah, in fact I didn't even think twice and neither did he! so if they would've asked we would've mentioned it, but it was never mentioned nor did we say

That's great! Did the officer ask for any proof of ties to his home country, return ticket, etc.? Sorry for all the questions but we are preparing to have my husband come for a visit and I want to be fully prepared. Also what was the point of entry? Thanks in advance!!

It probably helps I've visited a few times - and never overstayed. 

 

As for withholding information, you don't have to tell the officer your doing the I-130 but if he asks you must answer all questions honestly. As long as you don't out right lie nothing will come of it. 

 

Your husband should be fine, remember you're not doing anything illegal - you are allowed to visit your spouse. 

This is so true, it is not illegal so why does it feel that way? Lol. It's so nerve wracking that there is always a possibility that an officer can deny your entry and make you pay for your way back. But this is great advice Martin bk. Thank you so much! That's the route we're going to take, don't ask-don't tell. We won't mention the I-130 unless they ask. Thanks again.

No, no questions asked.  They may have asked when he was returning - possibly had to show ticket, but we went through the customs line together as we're married, so I think that probably led to less scrutiny.  We entered in LA. I'd say as long as you have a return ticket and genuinely intend to return it's fine.

I agree, if they ask, tell them.  but I had completely forgot we applied and didn't even think it'd be an issue as we were there visiting family, so as long as you're honest it's fine
