Exactly my point, that is what the form I-129f (not I-120f) instructions say. The instructions say submit evidence of filing an I-130, they do not say submit the I-130 Receipt Notice.

Think about it for a moment and you will be able to identify other evidence that also demonstrates that an I-130 has been submitted.

I thought that the form I-120f says that if you're submitting this form for K-3, you need to show proof that you have already filed I-130.

Yes, my interpretation was the same as Yodrak.

It is of course straight forward to send the I-130 Receipt Notice, but because I already knew my I-130 file number before I received the I-130 Receipt Notice, I sent my I-129F together with several evidences (including the file number) that I filed the I-130.

I-129F without I-130 Receipt Notice was received by NBC and transferred to CSC today.

Now I am planning to call CSC and send my I-130 Receipt Notice if they still want it.

Received both approvals on March 28.

I included copies of I-130 with my I-129 petition and also indicated on G-325A ("This form is submitted in connection with an application for: I-129 & I-130"

we are applying for K3

and sent the I-130 and I-129 on the same day to the same place (california service center)

and now we got the NOA of I-129

what should we do now?

we are supposed to get NoA of I-130 right!!!!

is everything ok now?

Well, I wonder whether sending I-130 ad I-129F on the same day is a good strategy.

Although the instruction of I-129F states what they need is the "evidence that they filed Form I-130," it is not clear what qualifies as a sufficient evidence. I-797C surely be a firm evidence. File number of I-130 petition maybe or not (my case). Copies of I-130 is a bit weaker.

Even after receiving NOA1, something unusual may happen before the approval (I assume "approvals on March 28" in the above post is not an "approval" but receipt of NOA1).

I am not blaming people who did that but I am a bit concerned because I want this website to provide relyable information and not encourage people to go through uncertain methods. Reporting our own experience is fine but we must be careful not to mislead others.

Although I filed my I-129F without I-797C, I understand it is not usual and I am going to ask CSC whether I need to send I-797C subsequently from now.

I am certainly not encouraging anyone to do what i did. I am just sharing my experience.

To be honest, i was a little freaked out when I looked at the k-3 guide where it tells you to send your I-130 NOA1 with I-129F.

But sending both petitions worked for me. And I did receive the APPROVALS (NOA2) for both on March 28th.

I also would not encourage others to do what you did. But your experience certainly is interesting!

Hopefully others who make the same mistake, such as wendyhigh who started this thread, and others who may be bold enough to try a concurrent submission deliberately, will report their experiences. If a consistent pattern of success develops then we will have learned something very useful indeed.

Here's some new information:

The United States Citizenship and Immigration Services (USCIS) recently announced new filing procedures for Form I-129 (Petition for a Nonimmigrant Worker) and Form I-539 (Application to Extend/Change Status). Effective April 2, 2007, these filings will be the first applications affected by the recently implemented Bi-Specialization policy which distributes petition documentation to specialized service centers.

Petitioners will be required to file these applications directly with the service center that has jurisdiction over the place of employment or residence. These forms will be either filed with the Vermont Service Center (VSC) or the California Service Center (CSC). Once the petition is sent to the VSC or CSC, petitioners can expect that the receipt notice and approval notice will come directly from that service center. This revised process should simplify the previous procedure of sending the applications to one service center which would then subsequently distribute to another for adjudication.

A grace period has been announced between April 2 and April 16 during which the USCIS will accept all I-129 and I-539 petitions regardless of the new filing procedures. Also, H-1B petitions that have been prepared in advance of the April 2 filing date do not require a change to the service center address on support letters or documents, but should be sent to the service center that currently has jurisdiction. Beginning April 17, 2007, all cases must be sent to the correct service center or the petition will be rejected and returned with fees and instructions for proper filing.
