I got blue..they think our case is fraud because of my fiance did another K1 before.

At the interview they just asked me about his first case, they didn't ask anything about us.

Do you have any suggestion?

I am sorry to hear about that. I went through a 221-G with my first fiancee so I can empatize with the feeling.

If they gave you the blue slip, the 221-G then they did not deny you for fraud. Usually with a 221-G they do one of two things. Ask for more information about something they want more proof on or tell you it is going to go through Administrative Processing which is basically a check of names for terrorist or criminal activity (or visa fraud). What was noted on the blue slip?

If they kept the passport and gave you a blue slip then it really is not that bad of a sign. I think in reality you are running into the same thing I am but at a different point. It is the second visa for different people for both me and my fiancee and we are in A/P at the NVC level.

I wish you the best of luck. Tell us more about what was checked on the blue slip and we might be able to tell you more.

They gave me the blue slip says:

Based on the information ascertained through the visa interview and through documentary materials, consular officers do not believe that there is a bona fide fiance/spousal relationship between Petitioner and Beneficiary. If you have any other evidence to present which would convince a reasonable person that the relationship exists for a reason other than immigration, please submit it.

What should we do? We submit all the evidences (phone bills, email, chat log, travel photos, travel tickets, hotel's receipt, cards, letters, photos of engagement party.) we have. How do i prove our relationship is true?

Do i resubmit all the evidences again?

just relax and dont worrie if u dont have any criminal history

i had the same and after 5 days they contacted me and they r ready to issue me a visa .i was interviewed and i am a student from pakistan and i will be with my sweet heart very soon .i m in londodn at the moment

I am sorry to hear that you got a blue slip. I know you are feeling sad at the moment. I just give you my ideas and hopefully it can help. Since you told they suspected on your relationship, and since you showed them all necessary envidences to prove your relationship but they still doubted on you, i think, now you should need the third person whom knows your relationship well enough to interfer this. It will be more convincible if the third person is your fiance's relative, he/she could be sister or brother of your fiance whom can state in the letter that your relationship is true, not fake.

It is just my own opinion, and i believe there are still some other people here who can give you their wise advices to help you overcome this situation. You should be fine, God will help you.

They are requesting additional information to prove a bonafide relationship so you don't want to re-submit what you have sent already. If they think that your K1 is fraudulent, you may have to go outside your family and your fiancee's family for support.

You may want to get signed/notarized affidavits of your USC's friend, boss, aquintances acknowledging his intent to marry you and the ongoing relationship.

You haven't provided us much information as to why a K1 was filed previously. Is your fiancee divorced from his prior K1 fiancee? Or did he just cease the processing before she arrived in the US? If he ceased the processing, then he may want to write a letter explaining why.

I think you should respond with whatever you can. If you do nothing the file may just sit there for the alloted 60 days and then go back to NVC and you are toasted at that point.

Do you have any additional photos you have not submitted. Try to think of anything you can add. Resubmit what you did previously and everything else you can think of. Letters from friends, family etc. I had the same thing happen but we were together when we got the blue slip. We took photos for the next few days. I sent 40 photos of us together, more messages, the few phone bills we had and all I could think of. a week later we had the visa.

I am sorry to hear this!

I was given a blue slip also - but for fiancial purposes, I still have my passport but I had to send my stuff back, so mine was relatively easy to sort out but I do understand how you feel!

I agree with the others about the affadavits, your family members, friends even? saying they know you.

I read somewhere that relationship affadavits should include the persons name, address, date of brith and social security number stating basically that they know you, your fiance and that you have a bona fide relationship and that they have seen you in this that or the other kind of social situation on this date or in this time period.

Affadavits from your fiance's family and friends is always good. Try to think outside the box. I would recomend the following and whatever you can think off:

-Have your fiance signed a notarized statement with an explanation of his prior K1 since they've seem intrested in it. Remove all doubt (finished, over, didn't work out, she was snoring too load, whatever, just be truthful). Did your fiance mention it when filling out the petition? It appears this is the main area of concern. I would focus on this as you seem to have enough evidence. Submitt more if you have them.

-Show them your engagement guest list. My fiance's father is working on our guest list with their names, numbers, and addresses. A monumental task as he invited over 300+ people, that's not including waiters, vendors and such it could go up to 400.

-Perhaps a letter from yourself address to the consulate with an explanation is in order. It would be your version of the story.

-Letter from your parents showing support of your bonified relationship. Don't want to say to "give you away" but rather support as to balance the two cultures out. Even thou this is the US Consulate they must reconize the local culture and tradition. Use that to your advantage. This is in an area where approval from the parents is a big thing, if not the ultimate decision.

He didn't write the cancellation letter for the previous. They broke up because she had another man in Vietnam. He wrote a letter explain about his relationship to USCIS. (USCIS intend to deny my K1 because he did 2 K1 in 2 years, but we got approved)

09/2005: back to Vietnam dated me.

09/2005: trip to Singapore and Malaysia

10/2005: trip to China

08/2006: filed my K1

11/2006: got approved

03/2007: interview -------------- blue slip.

The Problem is: in 07/2005 he appealed for previous K1, 09/2005 he dated with me. His previous fiance still in Vietnam. They think his previous K1 is fraud too.

Our story is that. Please give me some suggestion.

In this case the blue slip and required documentation has zero to do with criminal history. They have cited a specific reason for the denial and have requested specific information. Follow the advice provided here and speak with a lawyer. If they suspect both I-129F petitions were cases of fraud, especially since he was involved with you at the time of his previous appeal, you have a lot of work ahead of you to prove them wrong. Don't take it lightly and good luck.

the only suggestion i might add that might help is to have your Fiancee get in touch with his local congressman or senator's office.

a good lawyer would not hurt too.

"Hmmm, dating a new girl while repealing another K-1 for someone else? This gotta be a biggest joke in the history of K-1 Visa, what is this guy thinking? That we Consulate Officers are a bunch of tools? or fools? DENY!!!! BAMM, SLAMM, DONE!"

"Falling out of and in of love within 2 months? This guy is ruthless! Must be a crazy to approve his case! Deny!!!!"

Now, your turn: how do you overcome their legitimate doubts and distrust your fiance's (USC) intention and motive. Let's read the post everyone has been telling you: get a lawyer! Let's not come to conclusion too fast, this is NOT a denial, it's a delay and giving you a chance submit MORE evidences and it is a good time to retain an attorney!!!
