Just checked how long it has been since USCIS received my case. If my ROC process was a pregnancy, i'd be due in around 10 days :whistle:

HI I submitted my application sometime in Nov 2016, received my NOA on nov 19, 2016 and had my biometrics on Dec 6, 2016. I still haven't heard anything back after that.  Is there any way we can check our status aside from checking your status online because it seems like they don't update that site much. Thank you!

Unfortunately there's no other way to check status of your petition other than what you see online. A level 2 immigration officer can do, however; there's no need for you go go through that as you still have months of waiting due to current backlog. Even if you call and speak to one, that's what he/she will tell you. As of now Vermont Service Center seems to be making some progress with some September 2016 filers getting approvals. California though on the other hand is having serious backlog issues and still stuck with some June and July 2016 cases. There might be a little light at the end of the tunnel for you if you flied at Vermont in the next 2 months or so. If you filed at California then you're gonna have some serious waiting to still do.

My wife filed the I-751 in December 2016. We recently called USCIS and they confirmed they are currently processing June 2016 applications. By those numbers, it appears we will not have our process completed until 2/18, correct?

 

We understand that they are swamped and have a long backlog, and are ok with the wait, but I need confirmation of what it means to have a completion date of 2/18. Specifically, I was under the understanding that the processing had to be completed within 1 year's time otherwise deportation could enter the picture if she is in the US more than 1 year after the filing deadline for our I-751. Is that correct? If not, what will her status be past the 1 year mark? If she requires evidence for something of a conditional permanent residency, how can that be provided past that point? Any information on this would be helpful. Thank you.

You have a valid extension letter (NOA1) correct?  When does the extension letter expire?  If you are nearing the end of the extension period and your case is still pending, I believe you can schedule an infopass appointment to get a 1 year I551 stamp in the passport which is another 1 year extension for the GC.

Yes I do have an NOA1 stating that "Your conditional resident status is extended for a period of one year." The receipt date is 12/6/2016. When my wife went to her biometric interview they took her password along with the other evidence they requested. How would we get a stamp in her passport in this case?

I am confused.  They confiscated her foreign passport at the biometrics appointment?  If so, I would schedule an infopass to get it back.  Also, the extension letter extends the green card period for one year based on the expiration date of the two year GC, not based on the receipt date of the extension letter itself.

So it's really looking like (at this point) that all of us in here will be waiting well beyond a year, meaning those of us here on marriage based green cards will be able to file for Citizenship before our ROC gets finalized as already mentioned.

 

My Green card says resident since: 03/16/2015, 90 days before that would be 12/16/2017, am I reading that correctly? We can apply for Citizenship 90 days prior to our Green card anniversary?

 

How many of you in here are going to be taking advantage of that in order to push the ROC process through? I'm curious to know how they actually works

I'm resident since 03/26/2015 and I'm going to apply for Citizenship in December.

Yes your 90 day window opens up on 12/16/2017 and you can file on that day. I'll be filing on 12/04/2017 as my window opens on that day as well. I have everything ready.

Hey guys I had a quick question. Do we have to submit proof of a bonafide marriage once again when we apply for Naturalization? Will we still need to have one of those interviews where they ask both the spouses to come?

Hey Starkilla09 can you run through all the things you have ready in order to file for Naturalization? You sound extremely prepared and I want to make sure I am on the right track. I think my window opens up in November as my Resident since date is 2/24/15.

No there's no stipulation in the law that mandates your I-751 to be adjudicated within 1 year from the date it was extended. With that being said no you won't be facing any deportation whatsoever if your I-751 is not adjudicated after 1 year of being extended. You still remain a permanent resident for all intent and purposes until it is adjudicated no matter how long it takes. What you need to do by then is schedule an infopass appointment to get your passport stamped to show evicdence of your status especially for travel and employment purposes since your card and extension letter won't cut it anymore by then as they'll be past expiration.

Yes you have to submit some light evidence to show ongoing marriage though not as heavy as your I-751. A few sparing joint financial liability documents for the past few months like utility bills, joint bank statements and anything to show you still have an ongoing marriage will do. It's not an I-751 again so you don't wanna overload your application. And no your spouse isn't needed for your naturalization interview.
