Generally, certain lawful permanent residents married to a U.S. citizen may file for naturalization after residing continuously in the United States for three years if immediately preceding the filing of the application the applicant has:

  · the U.S. spouse has been a citizen for all three years and meets all physical presence and residence requirements
  · the applicant meets all other naturalization requirements

Using the term "residing" doesn't necessarily require permanent residency.

3 years start when we got the Green card and we can calculate 90 days based on residence since date on green card.

Timeline

I think "living" or "working" legally in the USA is not the same as residing.. to be a resident you need to have a "permanent resident card" .. If you have a work authorization card then you are a non-immigrant that is bound to leave the USA at some point whereas a green card holder is not - i might be wrong on the explanation here;)  So the three years count from the time you became a resident - got a green card. If in doubt, you can always send an application and see if USCIS sends it back to you. Then you will know for sure that it's too early :)

Not sure of my receipt date for NOA1 as I never got the letter in the mail. When I called she said it had been accepted which was Jan 22, 2017. So I guess just put that date??

 

Hubs just finished biometrics. Woo!

Ya I went through the April forum and noticed many people who haven't be approved yet and it's been 9 months. 6 to 7 months used to be the norm for California but it has fallen behind as well. Either way I'm sending in that N 400 application the moment my window opens on December 4th and be done with this immigration fiasco. Been a crazy journey all the way from F-1 to this point.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

If you look at the Naturalization Eligibility worksheet on USCIS.gov. Page 2, number 3 it says "I have been a permanent resident for.." and if you follow the arrow to "less than 3 years" it says right there "you are not eligible for naturalization". Which is much more clear than what the guide on VJ is saying.

I would never use the VJ Guide as my be-all-end-all source, I'd always go with the official USCIS information personally, but the VJ guide is misleading, and should be updated...that was the point of my post.  Everyone that's commented clearly agrees that it is inaccurate...

 

Anyway, the conversation helps time pass as we twiddle our thumbs.  I am firmly of the belief that if/once new immigration changes are announced, it is going to throw all our existing applications into turmoil while they try and figure out the new priorities and policies.  As long as they have processes that continue to allow us to travel and work through it, we will manage.
