Hello everyone,

I came to the US in February to visit my then-boyfriend with the intention of going home to Canada in April. My passport was stamped to return May 1st. B-2.

My now husband and I have gotten married in April and I have been here since then.

Due to unforeseen financial problems, we have not been able to file for the i-130 and i-485 since then.

Now we are getting the packages together, and I am panicking about the overstay. I am over the 180 days, and I am losing sleep over this fact.

Please let me know if you think this will be an issue, as I am very concerned at this point.

NOA email received: 01/09/2017

NOA letter received: 01/13/2017 (dated 01/06/2017)

Any overstay will not prevent an AoS application you file from being approved.

Since you're over 180 days then you do have a three year bar but that won't be triggered until you depart the US.

Being over 180 days will be a problem. Seem like you just passed it. Send everything in immediately.

I know financial hardship can put a damper on plans but you really should have either sent in the I130/I485 or taken a quick trip back to Canada. Like Hypnos said you may have to serve out the ban.

Borrow money from friends or family to file AOS before i94 expiration? well moot now. File ASAP, don't leave the US until GC is hand, not even on AP.

Should be fine to travel on AP as it no longer constitutes a "departure" to trigger a bar as per matter of Arabally since 2012, however; it's advisable to wait until green card is received to travel. As many have mentioned just file your paperwork not something to lose sleep over.
