AOS and Applying for Advanced Parole (I-131)

Hi,

My wife (formerly fiance...successful K-1 fiance, yay us!) has an appointment tomorrow to visit the USCIS office to submit her documents for AOS along with EAD and request for advanced parole.

My question is, we have a wedding in cancun we want to attend in february, another in in vancouver in march...under the latest I-131 forms and instructions (expires November 2016 but still valid until they update onsite), it says that vacation is not a valid reason and we would not qualify to submit a I-131. However, it only states that if we fall under filing for a DACA, but we are filing a non-DACA.

We have the form filled out and I am prepared to submit an additional sheet of information detailing the upcoming trips, but am I wasting my time here? Our friends went through this process in 2014 and the process has changed because their forms did not require a supplemental explanation sheet for their itineraries. Please help!

AoS applications need to be submitted by mail, not in-person. It's unlikely they will accept those documents from her tomorrow.

And you are conflating humamitarian/DACA Advance Parole with normal Advance Parole. For the former then yes, it's certainly true that you need a valid reason to obtain it and a vacation does not count. For the latter though - and this is the one you would be applying for as an interim benefit from filling an I-485 - almost any reason for travel is a permissible purpose, including a vacation.

How did she make an appointment? Is it an infopass?

No documents for AOS or such are ever accepted by office/hand.

To the OP: The other factor here is that the I-131 (Advanced Parole) takes about 90 days to get give or take. You probably will not make the cancun wedding and it may be close for the vancouver wedding depending on when it is. If you still want to go without AP that is ok, but your spouse will have abandoned status and not be allowed back to the USA as they would not have a valid travel document to re-enter the USA. If your spouse left without the AP you would have to start all over again with the CR-1 spousal visa. Also USCIS will not expedite the AP for weddings. They only expedite for family emergencies and things like that.
