I would go to an immigration attorney ASAP. Even if it's just for consultation. It's usually free for just consulting.

it's not clear. Are you going to the interview in your country embassy? If all documents are approved, they may issue your visa with all this situation. If you are going to the interview in US, your husband needs to go with you, you could be denied or delayed if he is not present.

But the most important, you and your kids, do you really wish to go to another country and be on your own when he is in jail??? I know America looks like a promised land from outside but, believe me, the woman with kids and no family support has a very hard life here and as a foreigner much harder. I would recommend to research what is his sentence and for how long he will go to jail? How do you imagine the life without him? How CO will think you go on a marriage visa to your husband, to be with him and he is not with you???

Sorry about your problems, be strong and try to do the right thing, good luck!

She is here in the USA, its a Adjustment of Status interview.

Consult an immigration attorney, but go to the interview no matter what, otherwise you could be denied.

Are you working? I'm asking regarding becoming a public charge.

As others have said seek FREE legal advice.

Make sure you attend the AOS hearing with all required documents. Don't be fearful that they will deport you on the spot that is NOT going to happen.

Might depend why he is custody.
