Help

My wife came on K1 visa that was valid for the normal 90 days, "expiring" in Mid-March,

we got original Social Security Card with her maiden name in the first month of

her arrival after we got married. She is now on AOS that is pending, and the I-94 has

"expired".

We applied for "new" Social Security Card with her married name in Mid-February,

they "said" everything was fine and that we would get it in 2-weeks. They took the

original Social Security Card at that time.

Now, they are refusing to issue Social Security Card saying that the I-94 has

"expired"! what the heck? We had a Social Security Card and a SS# originally

in the first place, help

anyone else have this problem, or any idea what the heck is going on, we had the

same problem with the DMV, why doesnt USCIS provide *anything* to prove that

she is here in US legally once the I-94 expires, all we have is the letter indicating

receipt of the AOS request and nothing else

We have a similar timeline with regards to the social security card. We got the 1st social security card in January and applied to change the name on Feb20th. We were told that it would take two weeks; we went to the social security office on March 9th to check on the status of the name change. They said it would take approximately 4 more weeks to get it fixed. I am suspicious if they are giving me the run around and will later refuse it. The only thing I can think of is to go back to the social security office and request to speak to a supervisor.

1. you should not have given them the original SSN card back....

2. they will not issue a new SSN card if more than 76 days have past since issue of I-94...

3. nothing you can do now until your wife gets her EAD or Greencard as she is no longer allowed to work and therefore does not need a SSN...

The number is going to be the same even with the name change. She can still use that number even if she doesn't have the card at the moment.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

I'm not an expert as I'm reading up on this for our next stage too..but I'm not a 100% sure #3 is totally accurate since I came across this discussion thread earlier today...it's essentially about the same thing and hope you find it as helpful as I did.. :thumbs: (if you haven't already found the thread yourself).

For a K1 entry, if the work-authorized I94 has expired and the immigrant has no other proof of employment authorization (EAD or greencard), an employer is instructed on the I9 form that this immigrant is not legally authorized to work in the US.
