Entry on CR1 visa with petitioner outside of US

Timeline

Hi guys,

So my CR1 visa was finally issued yesterday. Both me and my USC spouse are currently in Egypt. Is it OK if I enter the US on the CR1 a week or two before my wife (USC petitioner) if she has to be here in Egypt for some family commitments ? Reason being, I have a job in the US and they'd like me to start as soon as possible. If that's not allowed, I'd have to travel around the 18th or 20th of January which is a bit of a delay.

CR1 visa holder cannot enter the USA BEFORE the USC petitioner.

You CAN enter without but not BEFORE the USC petitioner.

Done with K1, AOS and ROC

Petitioner must have concurrent (or established) US domicile for the beneficiary to avail an immigration benefit.

My attorney just confirmed that it possible to enter the US even if the petitioner is not in the US at entrance time ..

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

When traveling to the United States, the primary (or principal) applicant must enter before or at the same time as family members with visas.

Exactly, the primary applicant is me, the beneficiary. The US citizen is the petitioner or sponsor. The primary or principal applicant is the person issued the visa. I do not have any derivative applicants or dependents.
