What really gets me wound up!!! All of this happened because of someone choosing a few minutes of PLEASURE over their obligation as a married person! I wonder now, if she thinks all this was worth it?????????? Just my Opinion!

The husband thought he was saving his wife. I would shoot any man raping a woman. Related or not.

I agree with you! That wasn't the situation in this case! The wife was having a fling with the UPS man! All I was saying was; was all this worth the trouble that she is in for a few minutes of Pleasure with this UPS man? Alot of people in their families where affected because her desire to cheat on her husband! As for myself how I would have reacted; Maybe I would have shot the guy or maybe shake his hand and wish him Good Luck taking care of her! Nobody wins, Sad but True!!

wow...adultry...i willl never understand that...

I saw a Movie not long ago. It is called "The Painted Veil"..btw I highly recommend it for those that are into romance...but not a chick-fleak...actual serious, heartbreaking romance..:)

Well there is this high-class british girl that married a bacteriologyst some time back (i think it was the beginning of the 19th century). She didnt love him so she cheated on him with some PM of China. As a punishment he took her to China, during a very huge epidemy of some desease to the very center of it and wasnt talking to her for days...I think she got his point :) Watch it guys....awesome movie

Yes, and as his "crime" was nothing more than a little hanky panky, that would be a good thing surely?

Personally I can't believe they're letting the guy off. It should never be OK for a civilian to kill someone as they're fleeing the scene. I don't care what that person just did, because as shown here, the guy didn't deserve it, it was just the guy's wife being a ######. In a perfect world they would both be going to jail.

Any man (civilian or otherwise) defending his wife should have the legal right to kill a rapist as they flee the scene, especially at his own home. This is an isolated case of mistaken happenstance, but imagine if the husband walked up and the wife really was being raped. What's he supposed to do then? Calmly ask the rapist to stop, then wait for the police to arrive? All the while hoping the rapist doesn't have a gun or knife that he will use to kill the wife, and maybe even the husband too?

Rape is a serious crime that can result in physical/emotional harm and even sometimes leads to murder. It's not something to be taken lightly, or "sorted out" when witnessed, especially by a husband that's being told by his wife that she's being raped. To not take action quickly and decisively places the wife and husband too, in even more danger. During the commision of a crime, especially a crime on one's own property or concerning one's self or family, the rapist/murderer/assailant/suspect/etc., should be the one put in more danger, not the person defending themselves, their loved ones, or their property.

So, to say that in a perfect world they'd both be going to jail, I think you're sadly mistaken. If that were the case, there would be an exponential increase in rape, murder, assault, etc. To take away someone's right to defend themselves is to take away their deterrence against crime in the first place. The only things that stop criminals from commiting crimes are;

1. They might get caught and have to go to jail. (And in a crime like rape, that's not much of a deterrent.)

2. They might get killed in the commision of the crime. (That's a serious enough reason to stop anyone from doing anything.)

Whether the "rapist" didn't deserve to get shot is another story. There were at least 12 people in Texas that didn't think it was so bad.

Edited: And as Ron "Tater Salad" White (also a Texan) would say - "Guns don't kill people. Husbands that come home early kill people."

Generally with self-defense you're not allowed, within reason, to do more than you need to protect the life and safety of yourself or the person you're defending. So, it's not true that you'd have to let the rapist rape your wife; but if, say, you knocked the man unconscious, you wouldn't then be allowed to put a bullet in his brain. It can be different if the guy is fleeing versus advancing on you. What you're allowed to do can also depend on the time of day. (e.g., you're not allowed to use lethal force against a non-violent burglar in many states, but if he invades your home at night.)

If the guy's been frightened off and driving away, then he's no longer an immediate threat. At that point, it's not a matter of self-defense, but a matter of revenge.

I think Texas still has the heat-of-the-moment exemption, though, and I think that the grand jury was right not to indict him. But it wasn't a case of self-defense or defense of another if the guy's driving away.

His wife wasn't in the car, she was on the porch in her robe. The guy was driving away from the scene when the husband fired 4 shots at his truck, one of which hit his head.

If you think that's a justified killing, then you're a f**king idiot. Texas is just descending into vigilante justice. The wife and husband both need to go to jail, one for murder, the other for accessory to murder.
