Work Visa what documents are needed ?

OP, this is really not as easy as you think. Good luck with your plan, but there are some holes. Work visas are temporary. Are you going to pay for him in few years and sponsor his green card? Plus I don't think he'll be able to work anywhere else beside your business. And I don't know, but if I was an USCIS I'd find it odd that you're just sponsored an employee and then married him.. It looks and smells like you guys being to impatient and trying to skip the right path (K1), which might bite you later. Or it might now. Thought as a person who had to do her wait for the K1 process to be finalized, stuff like that offends me. People avoiding the right way by bringing their partners on work visas, tourist visas, student visas... eh!

Lot of misinformation on this thread, hopefully the Lawyer involved has a better idea.

Certainly is possible to immigrate through work.

You are right, there is alot of misinformation. I know there are loopholes in everything. It works for the Clintons and all the politicians why not us?

I just said that out of frustration,...but it is true.

In any event I am not in a big hurry as Roel had said and btw If she wants to go with the flow that is fine. Most people will ask questions and not go by just authority....hey drink the cool aid while u are at it , we all have our choices.

I would rather make up my own mind which so far leans towards the K1.

There is a whole alphabet of visa, some people on here obviously just know the family based ones and a limited amount about the others. Not loopholes just different options.

To get the H1B you'll need to apply for LCA and get the Prevailing Wages estimated. That process alone will take you about 6-9 months. You will also need to prove that there is no cap for your industry. You are obviously having a conflict of interest too.

Forget the L1. The O1 can be self-sponsored but it's not easy to get. The EB categories don't really apply here unless he goes for NIW or EB1A (both self-sponsored). If your company is an accredited academic institution you can try EB1B and if your company has a large international operations you can try EB1C (which is being now investigated for massive abuse). Then there are seasonal worker visas for agriculture, etc.

If the USCIS can prove, at any step of the process, that your intent was not to hire labor that you couldn't find among USCs and LPRs but rather a personal relationship, you face perjury charges (felony level crime) and he will get a ban for life.

Easier to wait for that divorce.

11/04/2016 I-140/485 cases transferred from Nebraska to TCS
12/01/2016 Prepared package for EAD/AP renewal (expires 04/09/2017)
12/23/2016 USCIS suddenly changes several forms, invalidating my EAD/AP renewal package (not yet sent)
12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)
09/14/2017 I-140 NIW approved!!! 
11/28/2017 RFE for new medical issued (plus another request re Supp J for employment which is clearly issued in error)
12/04/2017 RFE received in mail
12/07/2017 repeated medical exam for I-485
12/08/2017 Attorney receives documents for responding to I-485 RFE
12/21/2017 Response to RFE received by USCIS 
02/09/2018 I-485 approval (text, email) :)
02/08/2018 I-485 approval notice issued (the "welcome letter") - I'm LPR now
02/16/2018 Green card received
 
11/14/2022 Filed N-400 online; receipt and biometrics reuse form received online
03/07/2023 N-400 Interview scheduled 
04/xx/2023 N-400 approved, same-day Oath ceremony completed. I'm a US citizen.
05/xx/2023 US passport in hand
