Pregnancy + K1 Visa Question

Timeline

Hi guys,

I've scoured the site and running into a road block on what to do, here is our current situation:

My fiance lives in Canada is still waiting for her desk order divorce to be finalized (currently looking like the latest it would be approved is 12/21/17). Anyways we just found out that she is pregnant and we were intending to start the K1 Visa process straightaway after everything was finalized with her divorce but now are concerned with the timeline. Is there a separate process that we should be looking at, or is K1 the best way for us?

Is divorce still a year away?

Can't do anything till divorce is final, then bring her in as fiance or wife.

Is Canada like some states here where the dad is husband until ruled out by paternity testing :huh2: ??

no. a husband can be ruled a legal father in some cases, but not automatically

They have been separated for 1.5 years and her lawyer was finally able to get him to sign the needed documents a couple months ago so 12/22 is when the divorce should be finalized.

depending on where it is and any other issues, divorces get notoriously backed up in Canada. but since this is a desk divorce hopefully yours wwill not

Can you move to Canada? I think they allow partners to be sponsored.

depending on where it is and any other issues, divorces get notoriously backed up in Canada. but since this is a desk divorce hopefully yours wwill not

Yup we have been dealing with that this entire year so I am well aware. I know everyone keeps telling me to have the baby there, but just trying to see options I suppose.

The US process will take something like that and you can not start yet.

TN Visa? Do you qualify?

How long are you thinking the process to get her into the US will take?

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
