my fiancé and i went to out interview today and was denied under section 212 a 9ai but we are eligible for a waiver. The things is we filled our wavier before the interview and uscis said they received it June 6,2017 we even presented the printed out wavier packet..however the CO said it was not in the system. She then handed over some information to contact to see where our case is located. We called our lawyer as soon us we got home and told her the information. Everything else in the packet seemed fine and the CO's seemed very apologetic. Our just told its to stand by and maybe we can set another interview. Is there anyone on Visa Journey who has every experience anything similar to this or if anyone had any advice please feel free to comment. Thank  you 

They only told you that you need 212 waiver or you will also need 601 waiver?

What did your lawyer say? 

You can checkout Law offices of Spar & Bernstein,PC located in NY # 1 800 529 5465. They deal with all aspects ; concerning Immigration & more. They also have a FB live Monday-Friday 9am & 12pm (1hr) where they answer immigration  questions from any caller. 

well we have a lawyer and she told us to wait 15 days too see what happens next... we filled our waver already and uscis said they received it june 9 2017 the co's said it wasn't in their system just yet so we have to wait

Our's is still in transit since May4, do you guys have any idea why its taking time?

Usually only 1 year is required, but it is recommended to bring the past 3 years of transcripts to support your case.

Thanks. I have my fiance's tax returns, pay stubs of past two months and letter from employer. Would that be enough?

I think so. My fiance's interview is next month and I gave him 3 years tax transcripts and 3 months paystubs.

We actually got a reply from them and which said Visa will be issued on the name in Passport. But interview letter remains the same. Now almost all ready for interview, have medical appointment coming Saturday. 

My fiance lives in North Carolina. I am living here in Bangkok.

Hi, thank you, I think we will be to the interview before, we are the 17th I thought you said you were the 19th? So I will let you know how it goes, she has her medical Friday, I wish I had been talking with you all along, I could have had you talk to my fiancee earlier when she had the jitters about this whole thing, but she did everything perfect and now just medical and interview left!!

Hello everyone,

 

I am December filer and after a lot of wait time, my fiance finally went to her K1 visa interview at Guangzhou on Monday and was informed that she passed and got her issuance notice letter (we understand this is not guarantee, but looks very promising and we are excited). However, yesterday, she received a phone call from the consulate to inform her that although the interview went through, there is a possibility that it might be delayed or worst denied (alluding that it is under review?). When my fiance asked for more info, the lady said she didn't know anything beside just passing along the information.

 

Do any of you have similar incidences in your process? What are some of the reasons of such call?

 

We are extremely worried, any advice will be greatly appreciated.

I have no idea why some cases are taking longer than others to reach the consulate. I just found out that although my status changed to READY 2 days after "leaving" NVC that was just the embassy receiving the electronic version. Our hardcopy case finally got to there sometime last week, 4 weeks after CEAC tracker said it left NVC.

Oh my apologies. My interview date is 11th July.

Hi guys, 

it has been 1 month and 12 days since our case recieved by the consulate.

but I am still waiting for my Packet 3/4 since then.

i don't know why it's taking so long for the Embassy to send me the packet 3/4!?

i sent them twice emails and they responded that when we open your case will send you in shortly.

but it's taking forever 😞

Plus the CEAC keeps updating but the same "READY".

is this mean the consulate working on our case or what?

We are waiting as well. NVC received our case on June 7, still waiting for the embassy number to track on CEAC.
